China's fast industrialization and economic expansion has led to environmental degradation, prompting the government to implement a slew of environmental regulations and laws. This article examines how China's stringent environmental policies and legislation have impacted the development of environmental technology. The study's panel of Chinese companies confirmed that more stringent regulations really spurred innovation in green technology. This research lends credence to the premise that stricter environmental regulations are helpful in inspiring the development of cleaner technology that may help mitigate environmental issues. Research also shows that tighter environmental legislation increases environmental policy's effect on technological development. According to these results, environmental law may improve the efficiency of environmental policy by providing a hospitable framework for the application of technological innovation. The findings of this research have significant implications for Chinese policymakers committed to fostering sustainable development. The need of rigorous environmental rules to support comprehensive environmental policies that promote the development of greener technology is emphasized. The results shed even more light on how crucial it is to enforce environmental laws in order to ensure that environmental policies are effectively implemented. The new "Environmental Protection Law" (abbreviated as NEPL) holds milestone significance for the construction of China's ecological legal system. However, evidence regarding the impact of NEPL on sustainable environmental strategy (abbreviated as SES) still lacks empirical analysis. This study aims to examine the mechanisms and boundary conditions through which the NEPL influences SES. Utilizing a difference‐in‐differences approach, an empirical analysis is conducted on the data of listed companies on the Shanghai and Shenzhen A‐shares from 2008 to 2021. The findings are as follows: (1) NEPL has significantly promoted both the substantive environmental strategy (abbreviated as SUB) and symbolic environmental strategy (abbreviated as SYM) of heavily polluting enterprises. Compared with SYM, the impact of NEPL on SUB is more significant. (2) Analyst coverage plays a significantly positive moderating role in the relationship between NEPL and SUB, while managerial myopia plays a significantly positive moderating role in the relationship between NEPL and SYM. (3) Environmental legitimacy pressure exerts a mediating effect on the relationship between NEPL and SES. The research findings enrich existing theories related to strategic choice and environmental policy under government intervention and provide policy recommendations for enterprises to achieve sustainable development in the context of NEPL. Since taking office in late November 2023, the National/ACT/New Zealand First coalition government in Aotearoa New Zealand has made rapid, comprehensive and far-reaching changes to environmental laws, regulations and policies. Further significant policy reforms are pending. This article outlines the main policy changes and summarises the many concerns that they have generated. It then discusses the coalition's apparent rationale for the changes, focusing particularly on resource management reform. Following this, the article outlines the ecological values and principles that ought to inform environmental policy. It concludes with brief reflections on the longer-term implications of the coalition's approach to environmental governance and management and the wider global failure to tackle the current ecological crises. In many countries, complex environmental problems such as biodiversity decline are regulated at the national level by a disparate range of laws and nonstatutory policy instruments variously described by terms including plans, strategies, guidelines, statements of intent, and/or incentives. Such instruments are often grouped together by conservation policymakers and scientists under the umbrella term "policy." However, from a legal perspective, there are critical differences between these so‐called policy instruments. In this paper, we focus on what we consider to be the critical difference: whether a policy instrument is binding, and therefore whether an administrative decision (e.g., about a development proposal) can be legally challenged due to noncompliance with that policy instrument. Drawing from international examples, the aim of this paper is to give conservation policymakers and scientists the guidance needed to critically differentiate between laws and nonstatutory policy, assess current or proposed policies, and determine whether a nonstatutory instrument gives rise to binding obligations, thus allowing for decisions to be challenged before a court. In doing so, we encourage conservation scientists, policymakers, activists, and practitioners to reflect critically on what is possible and not possible when nonstatutory "policy" instruments are designed and implemented. In response to the limitations of the United Nations climate change regime, a range of dynamic climate governance arrangements have emerged, including minilateral 'climate clubs'. Although proposed as a solution to move international climate policy forward, depending on their specific design, climate clubs could raise implications from the perspective of the principle of common but differentiated responsibilities and respective capabilities (CBDR‐RC). Accordingly, this article aims to analyse different climate club design options through the lens of CBDR‐RC. First, it explains the general rationale for climate clubs and presents a spectrum of key club design features. Second, this article describes how CBDR‐RC has been operationalised under the climate regime. Third, drawing on current club‐like arrangements—namely, the Climate Club, the Clean Energy Ministerial and the proposed Global Arrangement on Sustainable Steel and Aluminium—it critically examines whether different design options are (likely to be) compatible with CBDR‐RC. This analysis examines the decision in Held v State of Montana by the Montana First Judicial District Court, in which 16 youth plaintiffs successfully argued that provisions within the state energy policy and the Montana Environmental Policy Act (MEPA) violate their constitutional right to a clean and healthful environment. As the first climate case in the USA to be brought based on a constitutional right to a healthy environment, it has received considerable attention and is being hailed as a landmark victory. This analysis examines the case in the context of recent trends in climate change litigation and argues that whilst the decision is indeed noteworthy, the circumstances that led to the decision make it unlikely that a wave of similarly successful claims will follow in the USA. Nevertheless, the case could mark a so-called 'constitutional rights turn' in climate litigation, as the case bolsters support for stronger protections for environmental rights. The Levelling-Up and Regeneration Act 2023 has marked major reforms in how planning law legally conceptualises policies, places and practices. This paper examines the move from anthropocentric to ecofeminist viewpoints in environmental policy and how this shift might be incorporated into a Pancasila-based solution to global environmental concerns. Anthropocentrism is the view that humans are the most powerful and valuable beings on the planet and that the natural world exists primarily for human benefit. This perspective has long dominated environmental policy, with laws and practices centred on exploiting natural resources for human consumption and economic gain. Ecofeminism, on the other hand, is a viewpoint that acknowledges the interdependence of all living things and the significance of safeguarding the environment for all life, not just human life. This viewpoint emphasises the significance of appreciating and safeguarding the natural world and acknowledging human actions’ impact on the environment. The paper suggests that a transition from anthropocentric to ecofeminist approaches in environmental policy is vital to meet the current global environmental concerns. Incorporating a Pancasila-based strategy, which is the philosophical underpinning of the Indonesian state and stresses the importance of unity, justice, and social welfare can give a framework for a holistic and sustainable approach to environmental policy, according to the findings of the study. The study implies that a Pancasila-based approach to environmental policy would emphasise the conservation of the natural environment and the well-being of all living things over economic growth and human profit alone. This strategy would also recognise the importance of indigenous knowledge and practises in environmental management and conservation. The study also emphasises the significance of including women and marginalised communities in environmental policy decision-making, as these groups are disproportionately affected by environmental degradation and have unique perspectives and experiences to contribute.

The Green Claims Directive (GCD),1 currently a Commission draft, represents the future legal framework for advertising with environmental claims, so-called green claims. The GCD is closely linked to the UCP Amending Directive 2024/825,2 which was published in the Official Journal of the European Union on 6 March 2024. The two directives are intended to form a coherent framework and are therefore considered together in this article. In particular, reference is made to relevant changes of the UCP Amending Directive 2024/825 in the text adopted by the European Parliament on 17 January 2024.3 On 12 March 2024, the EU Parliament voted on the draft GCD at first reading and adopted it with 146 amendments. The article is devoted to the analysis of the legal support of environmental policy in Ukraine. Based on the analysis of the articles of the Constitution of Ukraine, which guarantees citizens the right to a safe environment, it is assumed that the state is obliged to ensure environmental safety and preservation of the environment. It was emphasized that the environmental policy of Ukraine should be aimed at protecting the environment, rational use of natural resources and ensuring environmental safety. The author analyzed a number of normative legal acts that determine the priority vectors of environmental policy in Ukraine at various stages of the development of its statehood - starting from 1991 to the present day. Taking into account the goals of the state environmental policy, declared accordingly in the strategies, a conclusion was made about the urgency of environmental issues in the state management system and increased attention from the state to the definition, detailing, analysis and selection of alternative options for solving the environmental problems that have arisen. It was noted that environmental policy is gradually acquiring the characteristics of a full-fledged state policy and the corresponding sphere of state administration, where the state does not simply declare general goals, but defines tasks in the appropriate directions for the possibility of monitoring the effectiveness of statemanagement decisions and, if necessary, their further adjustment. The growing environmental crisis forces us to recognize that issues of environmental protection should become a priority for the Ukrainian authorities. The state should not only set goals, but also monitor their achievement and adjust plans if necessary. Ukraine should make environmental safety one of its main priorities. Scholarly work in the field of legal geography has grown dramatically in recent decades. While much legal geography scholarship has been influenced by a European-North American perspective, we argue that a distinctive legal geography scholarship also emanates from outside the dominant perspective. Here, we review research from Australia and New Zealand/Aotearoa and label this work as Antipodean legal geography (ALG). We suggest ALG research has made a significant contribution to global legal geography scholarship through an emphasis on environmental law and policy problem solving and through efforts to de-colonialise and expand legal geography's remit. As a unique environmental regulation in China, the official accountability audit was piloted in 2014. With a focus on prioritizing the ecological environment, officials in pilot districts have implemented economic construction, adjusted industrial structures, and promoted coordinated development between the economy and environment. The effects of implementation have garnered widespread attention from society. However, there is limited research on the impact of an accountability audit on industrial structure adjustments. Using the “Accountability Audit of Officials for Natural Resource Assets (Trial)” released in 2015 as a quasi-natural experiment, this study collected panel data from 279 cities between 2013 and 2017. It then empirically analyzed the impact mechanism and effects of the accountability audit on industrial structure adjustment using the Propensity Score Matching and Difference-in-Differences model. The research findings indicate that the accountability audit directly impacted industrial structure adjustment, promoting the upgrading of the primary industry to the secondary industry and restricting the development of the tertiary industry. In addition, the audit is beneficial for enterprise entry, but not conducive to technological innovation, and has no significant impact on foreign direct investment. Abstract This study examines the relationship between inflation and greenhouse gas (GHG) emissions in three major economies: the United States of America (USA), the European Union (EU), and China. The analysis spans from 1960 to 2021 for the USA and EU, and from 1971 to 2021 for China. A feedforward neural network model, optimized using the Levenberg–Marquardt backpropagation algorithm, was employed to predict GHG emissions based on annual inflation rates and fossil fuel energy consumption. The study integrates historical data on inflation trends with GHG emissions, measured in CO2 equivalents, and fossil fuel energy consumption, expressed as a percentage of total energy use. This multidimensional approach allows for a nuanced understanding of the economic-environmental interplay in these regions. Key findings indicate a nonlinear response of GHG emissions to inflation rates. In the USA, GHG emissions begin to decrease when inflation rates exceed 4.7%. Similarly, in the EU, a steep reduction in emissions is observed beyond a 7.5% inflation rate. China presents a more complex pattern, with two critical inflection points: the first at a 4.5% inflation rate, where GHG emissions start to decline sharply, and the second at a 7% inflation rate, beyond which further increases in inflation do not significantly reduce emissions. A critical global insight is the identification of a uniform inflation rate, around 4.4%, across all regions, at which GHG emissions consistently increase by 1%, hinting at a shared global economic behavior impacting the environment. This discovery is vital for policymakers, emphasizing the need for tailored regional strategies that consider unique economic structures, energy policies, and environmental regulations, alongside a coordinated global approach.

One of the fundamental tools to guarantee compliance with environmental laws is the sanctions, which act as deterrent mechanisms against possible violations. The present study focused on evaluating public perceptions towards environmental policies and sanctions, applying a methodology that integrates neutrosophy and indeterminate Likert scales to capture the complexity of human opinions on environmental legislation. By distributing a structured questionnaire to a representative sample, data was collected and subsequently analyzed using neutrosophic logic and cluster analysis techniques. The results underlined the importance of considering indeterminacy and uncertainty in the study of public perceptions towards environmental sanctions, providing valuable data for the improvement of environmental policies and communication in this area. ABSTRACT The Serra da Bodoquena National Park is an important protected area that promotes the conservation of a threatened ecosystem, the Dry Forest. It comprises two major fragments of predominantly Seasonally Dry Forest vegetation. The two fragments are under different protection schemes because they are considered different biomes. The southern fragment is considered part of the Atlantic Forest biome, and is thus protected by the Atlantic Forest Law, while the northern one is considered part of the Cerrado biome and is protected by the Native Vegetation Protection Law of Brazil (2012). This difference affects management and threatens the conservation of the National Park. The Native Vegetation Protection Law is more permissive, thus increasing the conflicts between the park and surroundings in the northern fragment. We used floristic composition to provide a more accurate definition for the two fragments with regard to their phytogeographical domain. Our results identified high floristic similarity between the fragments, indicating the same vegetation type for both. Among the 202 plant species identified in this study, 76% belong to the Atlantic Forest biome. This relatively high proportion indicates that the predominant vegetation and species composition of the National Park is typical of the Atlantic Forest. The occurrence of fragments of the Atlantic Forest, with a representative number of species of its flora outside the area of application of the law of the Atlantic Forest, defined by Decree No. 6.660 / 2008, indicates the need to elaborate or adapt the law to protect these fragments.

Currently, the environmental approach is included in the legal regulations of countries to achieve sustainable development. The development of public policies that demand the care and preservation of the environment is an urgency for the territories. In Ecuador, social and legal transformations led to the inclusion of the environmental perspective in the Constitution of the Republic, and subsequently to the development of the Organic Code of the Environment (CODA). Environmental principles are considered in the various legislations; however, no priority is established among them. The objective of this work is to determine the priority established in the environmental principles of CODA. For this, it was necessary to consult experts and, based on their criteria, the Pareto Diagram technique was applied, the fundamental principles were selected, and a hierarchical order was determined based on the Analytic Hierarchy Process, AHP Saaty, with a neutrosophic approach, for the decision making. The development of environmental law starting in the mid-20th century involved constant tension with private property. Attempts to protect the dwindling natural resources, extinct species of animals, and ecosystems at risk have often encountered obstacles when they demanded interference with private property. Although the theoretical roots of private property do not justify its transformation into an environmental obstacle and, to a large extent, attach importance to environmental values in justifying private property rights, it was private property that stood at the forefront of legal conflicts that revolved around attempts to expand the environmental protection of natural resources. The reason for turning private property into an obstacle to a proper environmental policy stems from adopting a concept according to which private property protects only human interests and values. In contrast, environmental interests that cannot be converted into human terms remain outside private property boundaries. This either–or concept, or as William Baxter termed it in 1974, “peoples or penguins,” harms the ability of courts and other decision-makers to implement a proper and effective environmental policy because it prioritizes human interests over those of nature and its resources. This Article claims there is no reason for the decision-makers to be forced to choose between people and penguins since the interests of both humans and nature can normatively, and practically should, find expression in private property. Private property as a legal institution is an arena for value discussion as well as for making balances between values that are perceived as necessary for society. The exclusion of environmental values from the value clarification conducted to define the scope of property rights is not only a normative failure but also harms the ability to deal effectively and adequately with pressing environmental challenges. The internalization of environmental values into private property, along with human (owner freedom) and social values (such as efficiency and shared welfare), will enable a proper definition of property rights and will provide courts and other decision-makers with the means to formulate, and implement, a proper environmental policy. The article deals with significant international environmental law developments from 2023 to 2023. Topics discussed include the seriousness of the environmental crises, the Kunming-Montreal Global Biodiversity Framework (GBF), and the forms of environmental pollution being addressed by international human rights courts.

Discussions on how the public engages with environmental information within environmental governance matters are primarily centred around the supply of environmental information to the public by the state. However, this focus downplays the importance of environmental information held by members of the public and the difficulties that individuals can experience when submitting such information to the state outside formal environmental decision-making procedures. This article examines the benefits of guaranteeing a general right to submit environmental information before considering the extent to which environmental law, specifically the Aarhus Convention, supports the creation of such a right. The article then concludes by constructing a hypothetical regime to implement the proposed right, identifying how the proposed right can be balanced against the needs of the state and points of divergence between this hypothetical regime and the current environmental information regime set out in the Aarhus Convention.
