The Tuxá people from Rodelas, in the Brazilian state of Bahia, traditionally live at the São Francisco riverbanks. Because of their historical dwelling in the place, many more-than-human relations have been established, especially with their ancestors, supernatural beings known as encantados who continue to live in the land. Nowadays, Tuxá teachers, working on a specific school curriculum, are revitalizing Dzubukuá, a language that they currently master only to a certain extent and within ritual contexts. Strengthening the relations with the encantados due to their continuous political struggle to guarantee Indigenous rights, the Tuxá have been emboldening their engagement with Dzubukuá revitalization through both the ritual communication with encantados and the linguistic studies based on a colonial bilingual catechism written in Portuguese and Dzubukuá. Here I demonstrate how Tuxá's understanding of territoriality, inhabited along with other cosmological entities, can offer a view of Indigenous knowledge, education, and resistance in Northeast Brazil. The political changes that took place in Brazil in 2022 brought a new hope for the protection of the forest and the different peoples that inhabit it. This article examines affirmations of differentiated Indigenous rights that are present in national and international legislation in the State of Roraima, Brazil, through significant efforts by Indigenous political movements, including activities by Indigenous lawyers. By creating internal mechanisms for solving conflicts, such activists contribute significantly to realising rights present in the Federal Constitution (1988) and the Indian Statute (Law 6.001/1973), and in international legislation such as the International Labour Organisation (ILO) Convention 169 (1989). These mechanisms include the setting up, by the Indigenous Council of Roraima (CIR) and local Indigenous leader councils, of written customary laws (regimentos internos) as an alternative for solving conflicts to avoid sending people to violent and overcrowded prisons. The efforts of Indigenous organisations, activists, and lawyers also seek to overturn a commonplace notion of equality before the law, which fails to consider existing inequalities. The article "Future Past: the history that 2022 will leave about 1822" is a special dossier about the 200 years of Brazil's independence. The text addresses different perspectives and interpretations about Brazil's Independence, divided into four sections: the people involved in the independence, the rights achieved, the projects, and the literature related to the theme. The dossier also discusses the presence of black people, indigenous people, and women in the history of independence, the role of non-white individuals in the independence throughout the Americas, and the participation of Bahia in Brazil's independence. Additionally, the article analyzes the history of Art Nouveau in Brazil in the 1920s, the narrative about Bahia's participation in Brazil's Independence in regional textbooks, the issue of slavery in the Independence, and the right to petition in the context of Brazil's Independence. The present article examines the right of prior, free and informed consultation of indigenous peoples in the light of International Human Rights Law, in order to verify the possibility of Brazil's international liability for violating this right. To this end, it uses as an object of study the case of the construction of the Belo Monte Hydroelectric Power Plant. It was observed, specifically, the understandings adopted by the Brazilian Courts and the Inter-American System of Human Rights in relation to the case of the construction of the Belo Monte Hydroelectric Power Plant. As a main methodology, the investigation is legal-comprehensive with a qualitative approach, based on bibliographical and documentary research. The results showed that Brazil ignores the international debate about this subject, to the extent that it has not ensured mechanisms guaranteeing the right to consultation of indigenous peoples, which enables its liability to the Inter-American System of Human Rights. This article analyses the impact of COVID-19 on the rights of indigenous peoples, particularly in Brazil. It deals with the current situation of the Brazilian indigenous peoples, the impacts of the pandemic, the rights created on the adoption of protective sanitary measures for indigenous people and land rights in Brazil. Does the Brazilian government comply with international law, with constitutional rights of indigenous peoples in the current COVID-19 crisis, particularly with the Brazilian Supreme Court decision on the adoption of protective sanitary measures for indigenous people? With a focus on the 2020 Report of the Special Rapporteur on the Rights of Indigenous Peoples, this paper will identify and examine the gaps in protection of the indigenous peoples rights by reason of the impact of the COVID-19 crisis. This paper argues that the crisis is misused as an occasion for land invasions, deforestation, forest fires and the denial of basic indigenous rights. Especially in Brazil, a transformative change, an emergency support for indigenous peoples, and a still stand agreement on logging and extractive industries operating next to indigenous communities are needed. Brazilian NGO statements give guidelines as to how to manage the threats of the present pandemic on indigenous peoples of Brazil. The Inter-American Commission on Human Rights, the United Nations and the International Labour Organisation all offer further relevant suggestions as to how to address the serious impacts in the response to and the aftermath of this crisis. In Brazil, only with the Federal Constitution of 1988 is indigenous peoples guaranteed the right to use their languages and cultures. However, since colonization, many languages have disappeared. The number of speakers of these languages has decreased, and different stages and language policies have promoted the Portuguese language at the expense of indigenous languages. All these factors to different sociolinguistic situations, current challenges in language teaching and learning, as scenarios of monolingualism in an indigenous language, continuum bilingualism, and non-speaking communities of an indigenous language. However, with revitalization, actions occur in the Brazilian context. We resorted to assumptions derived from studies on multilingualism, language policy, and language pedagogies. Based on these assumptions, this article aims to reflect on the moments and movements of indigenous school education and language policies in Brazil's multilingual and multicultural country. The writing of this article presents the importance and necessity of organizing and carrying out the indigenous cultural week as a space for knowledge, strengthening and resistance of indigenous communities in southern Brazil. The objective of this theoretical bibliographic and autoethnographic research, contextualizes the need to give voice and visibility to the more than 40 thousand Kaingang people of the South, seeking through the cultural weeks to show how important it is to respect the existing diversity in these lands. One of the most remarkable events of the cultural week is the recognition and identification of the Kamé and Kanhru clan moieties or marks, they are presence and movement, both in rituals, dances, food collection and family organization. In this writing dynamic, we want to expand the reach of dissemination and show the potential that cultural movements have in defense of the rights and values of indigenous peoples. The article analyzes experiences in archaeology and ethnology museums in Brazil that promote collaborative actions with Indigenous peoples involving studies of collections, exhibitions, preventive conservation, and collection management policies. We reflect on how these practices supplant thoughts and practices of the past concerning Indigenous rights, especially those related to the dialogic relations between Indigenous people and museum professionals, and the inherent conflicts, disputes and negotiations involved in decision-making. The policy for indigenous peoples of recent contact (PIRC) in Brazil is under construction. Although the guidelines for post-contact periods were present at other moments in government policy, they did not free indigenous peoples from cruel fates such as massacres, epidemics, and total extermination. Only after the policy change in 1987 were health measures included in post-contact actions and other actions with an educational bias. In recent years, there have been some advances in internal regulations related to various public policies, highlighting the publication of joint ordinance MS / FUNAI No. 4.094 on health care for indigenous peoples of recent contact. Likewise, the first Territorial and Environmental Management Plans (PGTA) have been formulated by indigenous peoples of recent contact in Brazil. Purpose: Standardized and generalized impact subcategories may not be representative of the social issues associated with the product analyzed in social life cycle assessment (S-LCA) studies. The analyst's knowledge about the product studied is currently considered to define the impact subcategories included in the study, characterizing a limitation to be overcome. This research proposes a method able to model the subjectivity associated with the selection of impact subcategories for S-LCA through a stakeholders' participatory approach. Methods: This framework is composed of three stages and was applied for the stakeholder "Local Community" of the fruit pulp produced in northeastern Brazil. The first phase identifies the representatives of local communities around the product's life cycle and the potential subcategories that can be considered. In the second phase, the preference elicitation process of these representatives is carried out. In the third phase, the information obtained is aggregated to classify the impact subcategories into relevant and non-relevant through the PROMSORT method. Results and discussion: The methodological steps were applied into two contexts: (i) individual perception and (ii) consensus perception. In the first case, the representatives considered the following relevant subcategories: access to material resources, cultural heritage, access to immaterial resources, and safe and healthy living conditions. However, the subcategories of community engagement and displacement and migration were not classified as strongly relevant. Only the subcategory respecting the rights of native peoples was considered non-pertinent. For the second case, the pertinent subcategories were access to material resources, cultural heritage, access to immaterial resources, displacement and migration, safe and healthy living conditions, and community engagement. The non-relevant subcategory also refers to respect for the rights of native peoples. Conclusions: The use of a participatory approach considering the stakeholders' perceptions for identifying the pertinent impact subcategories can better identify the social issues of a given product life cycle. This paper deliberates on the nature of justice in Indigenous engagement with settler-colonial legality. I use the case law-based evidence from the three jurisdictions, Australia, Brazil, and Canada, to reflect on the abstract and material representations of Indigenous environmental justice in contemporary settler-colonial societies. There are two elements at play here. While some of the constituent elements of 'Indigenous environmental justice' may remain undefined in the legal system, they function as an invitation to the courts for interpreting them widely. How far has this been used, and in what manner speaks to the nature of juridical engagement with indigeneity? Second, the need for certainty and procedural integrity within the legal interpretation often belies the assumption of neutrality. This is pronounced when political and historical questions are antecedents to the legal questions to be determined by a court. Settler colonial nations illustrate this contradiction by laying bare the past and present historical injustices that accompany Indigenous rights and sovereignty. To think about 'justice' in these cases requires principle-led juridical innovations. I argue that courts are yet to recognize their key role in identifying and remedying the violence scripted by the law on Indigenous people. While it may be a difficult and complex task to develop a radical jurisprudence without violating the separation of power, courts continue to be the final altars of justice with a wide range of creative and untapped powers. In this paper I explain why Brazilian indigenous land rights are being violated by the government’s large-scale development projects, by industrial farming, and by mining development. I also analyze why indigenous land rights are not historically and legally protected in Brazil. For indigenous peoples, the land is a geographic space of their own lives, a cultural space for the preservation of tribal culture, and a space for recognition that secures an identity based on their own values and worldview. It can be said that the indigenous peoples are the land. The problems related to indigenous land rights are summarized by the following four issues. First, the land rights law, which does not recognize the natural rights of indigenous peoples, is a form of implicit colonialism in that it does not take into account the past lives or sacrifices of indigenous peoples. Second, indigenous peoples can live in, but cannot own indigenous lands. This is because the owner of the indigenous lands is the federal government. Third, since the administrative procedure for designating a protected area for indigenous peoples has not been carried out within five years as specified in the Constitution, hence, it is not binding and the procedure itself imposes bureaucratic barriers which make it difficult for indigenous peoples to protect their rights. Fourth, there is a problem of equity with other minority groups. In the case of the escaped slave community known as the “Quilombo,” common property rights are recognized. However, indigenous peoples and non-indigenous traditional peoples are not recognized as exercising common property rights. Therefore, indigenous lands are occupied by the government's development policy, corporate agriculture and mine development, and indigenous people’s right to live is also seriously infringed. This article contextualizes the rights of indigenous peoples in Brazil and Chile in the democratic transition processes of these countries. The comparison is adopted to highlight the importance of constitutional rights for the recognition of post-authoritarian political regimes as democratically plural. The authors thus contribute to the debate on the necessary reform of State institutions in order to open legal and political spaces for the shared exercise of power with indigenous peoples in the country's decision-making processes and, above all, in the decisions that directly affect them, as are those pertinent to the great development projects and exploitation of natural resources in their ancestral lands. From the mid-1960s, Brazilian and European activists collaborated to raise awareness about human rights violations in Brazil, which at the time was under an authoritarian military regime. From reports on torture, to week-long conferences, cultural events, boycotts, petitions and protests, a wide range of activities contributed to the emerging transnational human rights movement. For the most part, activists focused on the themes of political repression, torture, inequality and development. However, at some point during the dictatorship, the discourse of Brazilians—and, by association, of their solidarity networks—began to address the indigenous question, raising indigenous peoples' struggles as a matter of human rights, as valid as any other, and contributing to their salience within the domains of international human rights organizations and institutions. Given the Brazilian Left's failures to cohesively mobilize for indigenous rights thus far, this change in discourse is deserving of further attention. In this article, I address the emergence of indigenous rights within the Western European network of solidarity movements comprising resistance to Brazil's military regime. These debates, as components of the transnational human rights movement of the 1970s, can be used to better understand the behaviour of Brazil's Left in this international setting, as well as the wider movement itself. Furthermore, it will be shown that indigenous rights were portrayed through the conceptual framework of 'Latin American Theory', as opposed to more commonly cited concepts of minority rights or multicultural citizenship. How to assess the issue of indigenous land rights in the face of manmade climate change and Amazon fires? How to classify the EU free trade agreement „Mercosur“ and relevant climate, environmental and indigenous rights? What are legal opportunities for indigenous people(s) on the international, inter-American and EU level, to prevent the loss of land and forests, and to protect themselves from climate change? On the basis of indigenous land and environmental rights in Brazil and reactions to the Amazon fires, environmental regulations of the "Mercosur Pact" as well as concerned human and indigenous rights are discussed. Further, this article deals with relevant inter-American law (individual indigenous land rights) and international law (collective land rights). Environmental and climate law provide legal and political options for indigenous people(s), for instance in Brasil. Negative impacts of climate actions on indigenous peoples, the competition between environmental protection areas and indigenous territories, the inclusion of indigenous knowledge in sustainable environmental protection and the allocation of Global Public Goods are discussed. There are various interactions between climate and biodiversity protection, human rights, indigenous peoples rights, and free trade between the EU and South America. While protecting forests as a carbon sink, negative environmental or social consequences must be avoided. Like trade agreements, environmental standards for the protection of the Brazilian Amazon rain forest should be enforceable. To reduce deforestation and to confine the effects of climate change, indigenous peoples rights have to be strengthened. The free, prior, and informed consent of indigenous peoples to projects that may affect their territories is essential. It requires effective, coordinated solutions to protect human rights and indigenous land rights, and it needs a sustainable preservation of climate and forests - nationally and internationally. A collapse of the Amazon forest ecosystem would have global climate effects. This article aims to explain about an indigenous trajectory in Brazil and the conflicts involving the right to use indigenous land, going through the impact caused by colonization, on cultural elements, popular communication, cultural hybridization and on the use of land with limited use to the productive activities and physical and cultural reproduction of the peoples, having as central axis the presentation of problems that involve access and recognition of the right to indigenous land, specifically, in the indigenous village of the Jaraguá / SP neighborhood. A survey was carried out through bibliographic surveys and official websites. Understand a property of the land as an original right, that is, that precedes even the same as the laws of the Federative Republic, the right that they are guaranteed, as a form of historical recovery in respect of what this people represents. The proposed study aims to analyze the problem of demarcation of indigenous lands in the southern region of Brazil. Initially, the historical aspects, relevant concepts, constitutional rights and guarantees of indigenous peoples and interventionist policies in defense of these peoples were addressed. In this sense, the role of FUNAI as an organ directly responsible for the demarcations was highlighted, but, especially the current situation of the processes of regularization of indigenous areas. The deductive method in theoretical and qualitative exploration was used as a scientific methodology with the use of bibliographic and legal documentary material. It was found that one of the main obstacles to the effective demarcation of indigenous lands is linked to the absence of public policies, in which the interests of certain groups overlap with diffuse and collective interests. In addition, the lack of trained civil servants at FUNAI, the low budget and the lack of staff in the judiciary, coupled with the great demand for lawsuits of all kinds, in all spheres of this power, end up generating the impasses the definitive demarcations, a since administrative procedures cannot be finalized and, in the end, a large part of these processes will end up in the Judiciary. The Brazilian 1988 constitution recognises indigenous peoples as ‘first and natural owners of Brazilians land’ and the 231st Article ensures their right to special territories where they could live their culture and traditions without colonising presence. The authentication of these territories, however, requires Public Power promotion, which lies on colonising, juridical accounts and depends on anthropological, scientifically historical research. Our argument here is that the bureaucratisation of the land demarcation process is only possible within a context ofepistemological advantageof science, i.e. modernity, which ignores indigenous territory and time conceptions. We will also argue that this bureaucratisation has been contributing to the (neo)colonisation of the territory by retarding the recognition and protection of indigenous rights. This study analyzes the experience of the Indigenous Paiter-Suruí in Brazil with the Fifty-Year Plan and the Forest Carbon project implemented inside the Sete de Setembro Indigenous Land (SSIL) with the support of distinct political players such as United States-based Google Earth engine, Metareilá, Ministry of Culture, Ecosystem Marketplace/Forest Trends, among others. Brazil has a long history of complex relations with Indigenous rights, including long-due discussions on identity, land recognition and demarcation. The concern with environmental issues brings in a different layer of political interests to the scene. There is very little dialogue on the acceptance of their forms of knowledge by mainstream society, and, as this study highlights, this relation to nature is being pressured to be commercialized and quantified in a Western-style system. The essay concludes that the Suruí pact to sell its Carbon Credits to multinationals such as Natura is a good example of this strategy of paradoxical post-modernity: the traditional local values and culture of the Indigenous society can be represented through new technology, but it is through those machines that the groups can be observed and appropriated as non-threatening to a global audience. This article traces different aspects of the present-day juridification and judicialization of indigenous lives using the example of the Tupinambá Indians of north-eastern Brazil. The Tupinambá’s identity is being increasingly bureaucratized by public administration and is constantly being questioned by public and private agents to deny the Tupinambá’s constitutional land rights. In the course of the still ongoing process of the demarcation of the Indigenous Territory Tupinambá de Olivença, indigenous inhabitants are facing a plethora of civil actions, and Tupinambá leaders are being persecuted and criminalized by the police and the judiciary. This article exposes the legal intricacies of possessory actions against indigenous people in Brazil and discusses the different acts and attitudes of the actors of the Brazilian ‘juridical field’ as regards the indigenous rights. It suggests a view of law, law enforcement and law suits as means of social sense making, that is, a public staging, interpretation, imagining and ‘mapping’ of Brazil’s ‘indigenous question’, which has, ultimately, to be legitimized by society at large.
