The article develops a set of indicators and criteria that must be used in the course of the development of rational options for the evacuation of special contingents from penal institutions by the military administration of the National Guard of Ukraine in the event of an accident at a chemical industry facility. Taking into account that evacuation is a multi-stage process, the article develops a number of indicators and criteria characterizing options for evacuation actions at each of the stages, namely: concentration of the necessary forces and means of the National Guard of Ukraine in the area of evacuation measures; the distribution and concentration of the forces and means of the National Guard of Ukraine in the relevant penal institutions in the pollution zone; evacuation of the special contingent from the contamination zone. The set of indicators included: quantitative indicators characterizing the need for automobile and landing resources for evacuating a certain number of prisoners; time indicators that provide an idea of the time of each of the stages and the evacuation as a whole; indicators in the form of distributions of transport and landing resources by certain points of entry (exit) into (from) the pollution zone, which characterize the spatial scale of evacuation actions; indicator of estimated financial costs for evacuation. On the basis of the developed indicators, a reasonable criterion for the implementation of a certain variant of the evacuation action plan is substantiated, which enables the commander (head) of the military management body of the National Guard of Ukraine to choose a rational variant of the evacuation measures among the set of developed alternatives. The developed set of indicators and criteria has a universal character and can be used when developing options for evacuation measures under different operational conditions, both during man-made emergencies and during the introduction of a special legal regime of martial law on the territory of Ukraine. The direction of further research should be the development of methods for the development of options for the evacuation of a special contingent simultaneously from several penal institutions in the event of an emergency at the regional level due to an accident at a chemical industry facility., Розроблено сукупність показників і критеріїв, які доцільно використовувати у ході вироблення органами військового управління Національної гвардії України раціональних варіантів евакуації спецконтингенту одночасно з кількох установ виконання покарань, що потрапили у зону забруднення внаслідок виникнення масштабної аварії на об’єкті хімічної промисловості. У ході розроблення показників і критеріїв було враховано те, що процес евакуації спецконтингенту з установ виконання покарань складається із трьох етапів: зосередження сил і засобів на межі зони забруднення; зосередження сил і засобів в установах виконання покарань усередині зони забруднення; вивезення ув’язнених із зони забруднення. До сукупності показників увійшли: кількісні показники, що характеризують потреби в автомобільному і посадковому ресурсах для евакуації певної кількості увʼязнених; часові показники, які дають уявлення про час проведення кожного з етапів і евакуації в цілому; показники у вигляді розподілів транспортного і посадкового ресурсів за певними точками-входу (виходу) у (із) зони забруднення, які характеризують просторові масштаби евакуаційних дій; показник орієнтовних транспортних витрат на проведення евакуації. На основі розроблених показників обґрунтовано критерій доцільності реалізації певного варіанта евакуаційних дій, який дає можливість командиру (начальнику) серед множини напрацьованих альтернатив вибрати раціональний варіант проведення евакуаційних заходів.

The article analyzes the content of economic activity of enterprises of the penal institutions of Ukraine as one of the sources of financing for the execution of punishment and the directions of institutions of the correctional and resocialization process of convicts in the colony and correctional institutions. This is one of the problematic (legal) aspects, which also affects the financial and economic situation of enterprises of the PIs, as well as in general, on the level and efficiency of the economic activity of the State Criminal Execution Service (DKVD) of Ukraine, the incomes of which serve as an additional source the financing of this system along with the expenditures, which are determined for the maintenance of bodies and GDP in the state budget of Ukraine. Inclusion of the proceeds from the labor use of the convicted persons to additional sources of financing of the State Committee of Internal Affairs of Ukraine. The economically important problem is that the State Criminal Execution Service of Ukraine is financed only by 40% annually from the State Budget; this state of underfunding entails a number of factors such as ensuring the legal rights of sentenced persons to serving sentences in penitentiary institutions, poor treatment of sick persons who are deprived of their liberty, lack of prevention and prevention of morbidity among inmates in penal institutions, low effectiveness of prevention activities with hvoryuvanosti also no special medicines and drugs to provide effective health care of prisoners. The State Criminal Execution Service of Ukraine for carrying out measures on correction and resocialization of convicted persons to imprisonment in penitentiary institutions, this issue is not sufficiently investigated, which in turn affects the state of operational and service and financial and economic activity of bodies and institutions of execution punishments and determines the relevance, the theoretical and practical significance of this scientific article., В статі піддано аналізу зміст господарської діяльності підприємств установ виконання покарань України як одного із джерел фінансування сфери виконання покарань та напрямів виправно-ресоціалізаційного процесу засуджених у колонії і виправних центрах. Це один із проблемних (правових) аспектів, що в тому числі впливає й на фінансово-економічне становище підприємств установ виконання покарань, а також у цілому – на рівень та ефективність господарської діяльності Державної кримінально-виконавчої служби (ДКВС) України, доходи від якої виступають додатковим джерелом фінансування цієї системи поряд з витратами, що визначаються на утримання органів та установ виконання покарань у Державному бюджеті України. Включення доходів від праце-використання засуджених до додаткових джерел фінансування Державної кримінально-виконавчої служби України. Вагома економічно проблема полягає в тому що Державної кримінально-виконавчої служби України фінансується з Державного бюджету щорічно тільки на 40%, даний стан недофінансування тягне за собою багато чинників таких як забезпечення законних прав засуджених осіб до відбування покарання в установах виконання покарання, неякісне лікування хворих осіб які позбавлені волі, відсутність профілактики та попередження захворюваності серед ув’язнених осіб в установах виконання покарання, низька ефективність проведення заходів з профілактики захворюваності, також відсутність спеціальних медикаментів та препаратів для ефективного забезпечення охорони здоров’я ув’язнених. Державна кримінально-виконавча служба України для проведення заходів щодо виправлення та ресоціалізації засуджених осіб до позбавлення волі в установах виконання покарань, дане питання досліджено недостатньо, що, в свою чергу, впливає й на стан оперативно-службової та фінансово-господарської діяльності органів та установ виконання покарань та обумовлює актуальність, теоретичне та практичне значення цієї наукової статті.

У статті зазначено, що злочинність є однією із значущих соціальних проблем, яка загрожує суспільному порядку, безпеці та стабільності функціонування держави. Схарактеризовано особливості перебування засуджених в умовах установи виконання покарань. Вказано, що на різні аспекти поведінки ув’язнених позитивно впливає зміцнення їх соціально-корисних зв’язків. Обґрунтовано, що одним із основних чинників виправлення осіб, які скоїли злочин, є соціальна робота з ними – професійна комплексна діяльність з надання соціальної допомоги й підтримки, здійснення соціального захисту засуджених, результатом чого є створення умов для їх позитивного функціонування. Зазначено, що соціальна робота в пенітенціарній системі спрямована на формування в засуджених сумлінного ставлення до праці, прагнення до дотримання ними вимог законів, а також закріплення у них законослухняної поведінки як в колонії, так і за її межами. Виявлено, що зміст соціальної реабілітації в установах виконання покарань визначається особистісними характеристиками засуджених, важкістю скоєних ними злочинів, якістю соціальних зв’язків та можливостями соціального працівника в пенітенціарній системі. На основі аналізу наукових досліджень визначено рівні (низький, середній, високий) соціальної реабілітації засуджених. Схарактеризовано найбільш результативні методи ресоціалізації (вивчення документів, бесіда, спостереження, аналіз медичних даних і динаміки розвитку особистості, незалежні характеристики, переконання, навіювання, регулювання психологічних спілкувань, передачі інформації тощо), а також вказано, що ефективними її засобами є: світоглядне, моральне, правове, трудове, духовне, естетичне, фізичне, валеологічне виховання; загальноосвітнє й професійно-технічне навчання; гуманне соціальне середовище; педагогічно доцільне дозвілля; гуманістична діяльність суспільно корисного спрямування; медичне, наркологічне, психіатричне обслуговування. Розкрито зміст роботи соціального працівника з засудженим напередодні закінчення терміну відбування ними покарання., The article states that crime is one of the most significant social problems that threaten the civic order, security and stability of the nation-state functions. Describes the features of the stay of convicts in the correctional facilities. Indicates that different aspects of the behavior of prisoners are positively influenced by the strengthening of their socially useful ties. Substantiates that one of the key methods of criminal rehabilitation is social work with people who committed a crime - a professional comprehensive activity in providing social assistance and support, the implementation of social protection of the convicts, which results in the creation of conditions for their positive functioning. The article notes that social work in the penitentiary system is aimed at forming a conscientious attitude towards the work of the prisoners, their desire to comply with the requirements of the laws, as well as the establishment of law-abiding behavior in the prison or outside. Reveals that the content of social rehabilitation in penitentiary institutions is determined by the personal characteristics of the convicts, the severity of their crimes, the quality of social ties and the possibilities of a social worker in the penitentiary system. The levels (low, medium, high) of social rehabilitation of the convicts are determined based on the analysis of scientific studies. The most effective methods of resocialization are described (studying documents, conversation, observation, analysis of medical data and dynamics of personality development, independent characteristics, beliefs, suggestions, regulation of psychological communication, transmission of information, etc.), and also indicates that its effective means are: ideological, moral, legal, labor, spiritual, aesthetic, physical, valeological education; general education and vocational training; humane social environment; pedagogically expedient leisure; humanistic activity of socially useful direction; medical, narcological, psychiatric care. The article reviles the content of the job of social worker with prisoners before their sentence expiration.

In this article the analysis of penitentiary system of Spain, based on the received material by results of a visit of the working group of the Ministry of Justice of Ukraine for the purpose of exchange of experience and establishing cooperation in the penitentiary sphere. Relying on the information provided by the management of governing bodies of penitentiary institutions, personnel of the polyvalent penitentiary centres, bodies of police, non-governmental organizations and on the results of own observations it is studied the structure of bodies and institutions which carry out the punishments established by court. The order of execution of punishments, connected criminals, with isolation from society is defined. It is established special peculiar features of criminal and executive policy of Spain. It is carried out the comparative and legal analysis of systems of bodies and institutions of execution of punishments of Spain and Ukraine, separate differences are defined, it is structured a chain of command by penitentiary institutions, their submission, a procedure of non-departmental control of their activity, and preventive mechanisms of violation of the rights of the convicted persons. It is defined the Types of institutions and local structural sites according to the content of the isolating regime actions which are applied. The analysis of criminogenic list of convicts, their age structure is carried out. It is established the components of efficiency of process of performance of criminal penalty in the form of imprisonment for a certain term, the organizations of social and educational work by introduction of the correctional programmes of their behaviour consisting in implementation of influence taking into account features of mental, psychological, emotional state of everyone’s of the convicted person, its educational level and requirements. It is carried out the analysis and generally functional orientation and the main objectives of penitentiary institutions of Spain, features of ensuring protection and supervision of convicts in the polyvalent penitentiary centers. It is established efficiency and universality of functioning of the polyvalent penitentiary centers of Spain of the latest sample. The author reasonably substantiates the expediency of introduction of separate elements of techniques of social and educational work with convicted of Spain in Ukraine, in particular the correctional programmes of behaviour of the convicts focused on specific features and needs of everyone’s of the convicted person., У статті проводиться аналіз пенітенціарної системи Іспанії, ґрунтуючись на отриманому матеріалі за результатами візиту робочої групи Міністерства юстиції України з метою обміну досвідом та налагодження співпраці у пенітенціарній сфері. Спираючись на статистичні дані, надані керівництвом органів управління пенітенціарними установами, персоналом полівалентних пенітенціарних центрів, органами поліції, неурядових організацій, та результати власних спостережень, вивчено структуру органів та установ, які виконують встановлені судом покарання. Визначено порядок виконання покарань, пов’язаних з ізоляцією злочинців від суспільства. Встановлено особливі специфічні риси кримінально-виконавчої політики Іспанії. Проведено порівняльно-правовий аналіз систем органів і установ виконання покарань Іспанії та України, визначено окремі відмінності, структуровано вертикаль управління пенітенціарними установами, їх підпорядкування, порядок здійснення позавідомчого контролю за їх діяльністю та превентивні механізми порушення прав засуджених осіб. Визначено види установ та локальних структурних дільниць у них відповідно до обсягу ізолюючих режимних заходів, які застосовуються. Проведено аналіз криміногенного складу засуджених, їх віковий склад. Досліджено критерії первинної та вторинної класифікації засуджених в УВП Іспанії, поділ їх на категорії залежно від їх суспільної небезпеки. Проаналізовано окремі алгоритми зміни умов тримання засуджених до позбавлення волі, їх умовно-дострокового звільнення від відбування покарання, звернено увагу на особливості кримінальної відповідальності неповнолітніх злочинців. Встановлено складники ефективності процесу виконання кримінального покарання у вигляді позбавлення волі на певний строк, організації соціально-виховної роботи шляхом запровадження корекційних програм їх поведінки, що полягають у здійсненні впливу з урахуванням особливостей психічного, психологічного, емоційного стану кожної засудженої особи, її освітній рівень та потреби. Проведено аналіз та узагальнено функційну спрямованість і основні завдання пенітенціарних установ, особливості забезпечення охорони та нагляду за засудженими в полівалентних пенітенціарних центрах. Встановлено ефективність та універсальність функціонування полівалентних пенітенціарних центрів Іспанії новітнього зразка. Автором обґрунтовано доцільність запровадження окремих елементів методик соціальновиховної роботи із засудженими УВП Іспанії в Україні, зокрема корекційних програм поведінки засуджених, орієнтованих на індивідуальні особливості та потреби кожної засудженої особи.

З’ясовано сутність злісної непокори засуджених до позбавлення волі в контексті визначених у законі підстав застосування до них заходів фізичної сили, спеціальних засобів і зброї, а також розроблено науково обґрунтовані заходи щодо удосконалення правового механізму з цих питань на індивідуальному рівні запобігання злочинам. The article defines the essence of malicious disobedience of prisoners sentenced to deprivation of liberty in the context of the grounds for applying physical force, special means and weapons to them, as well as scientifically based measures aimed at improving the legal mechanism on these issues at the individual crime prevention level. Определена сущность злостного неповиновения осужденных к лишению свободы в контексте установленных в законе оснований применения к ним физической силы, специальных средств и оружия, а также разработаны научно обоснованные меры, направленные на усовершенствование правового механизма по этим вопросам на индивидуальном уровне предупреждения преступлений.

У статті проаналізовані різні точки зору щодо поняття «персонал органів і установ виконання покарань» та визначені основні системоутворюючі ознаки, що складають зміст даного поняття та спрямовані на реалізацію основних цілей в сфері забезпечення безпеки та запобігання злочинам. The article analyzes different points of view on the concept of "personnel of organs and institutions of punishment" and identifies the main system-forming features that make up the meaning of this concept and are aimed at the implementation of the main objectives in the field of security and prevention of crimes.

Розглянуто сучасний стан наукової розробки проблем забезпечення безпеки в установах виконання покарань. Проаналізовано законодавство, що має безпосереднє відношення до забезпечення особистої безпеки засуджених. Зазначені вимоги і правила побудови правових норм, яких потрібно дотримуватись при видозміні чинного оперативно-розшукового законодавства України. Автор дійшов висновку, що в установах виконання покарань варто було б здійснити системні заходи, що обумовлені змістом сучасної кримінально-правової політики, які були б спрямовані на удосконалення системи заходів безпеки життєдіяльності у виправних колоніях. The article deals with the current state of scientific substantiation of the problems concerning the issues of security in the places of detention where the convicts serve their sentence. The analysis is focused on the legal acts and bills of law related to the personal security of the convicts and the need for modification of the existing penal laws in Ukraine. The author proposes a set of measures to be taken to improve the existing legal framework of draft laws and a variety of other legal sources aimed at the solution of the problem. It is concluded that the state at a legislative level ought to create the conditions of serving the sentence, which are aimed at the improvement of life safety measures in correctional colonies. The author singles out penitentiary measures and processes occurring in the course of serving a sentence of imprisonment, which fall into a category of a constraining factor for prisoners and for the rest of population. This article suggests the classification of tactical means in view of the absence of such both in the science of penal law and in the operational-investigative activities, and in the view of the existing practical challenges confronted by the operating units at the correctional facilities.

У статті здійснено аналіз нормативно-правових актів та стану лікувально-профілактичної й санітарно- протиепідемічної діяльності, що здійснюється в установах виконання покарань України та спрямована на забезпечення права засуджених до позбавлення волі на охорону здоров’я. The article is devoted to the analysis of legal acts and condition of medical and sanitary epidemiological activities in the penal institutions of Ukraine, which is aimed to ensure the rights of convicts to protect their health. The need to bring penal enforcement legislation of Ukraine in accordance with European standards is proven. Thus it is necessary to observe the requirements and rules of construction of the legal norms, such as: the presentation of norms in the articles of the legal act, the accordance of the adopted legal norms with articles of the Criminal Executive Code of Ukraine, peculiarities of the penal enforcement relations; the comparative approach to the formation of legal norms, the possibility of financing penitentiaries from the State Budget of Ukraine.

У положеннях наукової статті подається ґрунтовний аналіз окремих факторів та узагальнюються групи факторів які впливають на вибір тактичних прийомів та лінії поведінки учасників кримінального провадження у ході тактики провадження слідчих (розшукових) (розшукових) дій при розслідуванні злочинів в установах виконання покарань. The provisions of the scientific article gives a detailed analysis of individual factors and generalized groups of factors that affect the choice of tactics and policies of the criminal proceedings in the course of investigative tactics actions in investigating crimes in penal institutions. У статті проаналізовано й прокоментовано основні положення міжнародних і вітчизняних правових актів із проблем соціально-реабілітаційної роботи з неповнолітніми засудженими та запропоновано заходи, які нададуть можливість більш предметно підійти до вирішення нерозв’язаних досі питань у цій сфері. It is analyzed and commented on in the article the basic provisions of international and domestic regulations on social rehabilitation work with juvenile offenders and proposed measures which will allow more subjective approach to resolving problem issues which exist still in this sphere.
