Dužnička docnja je neispunjenje moguće, dospele i utužive prestacije za koje je odgovoran dužnik. Iz ovakvog određenja pojma proističe da je za njen nastanak neophodno da se kumulativno ostvari pet uslova. Prestacija koja se duguje mora da dospe na naplatu, da u tom trenutku njeno ispunjenje bude moguće i utuživo, neophodno je da ona nije ispunjena i da je za to odgovoran dužnik. Jedno od najspornijih u literaturi jeste pitanje da li je pozivanje dužnika da ispuni prestaciju – interpelacija – uslov nastanka dužničke docnje. Obrada izvora ukazuje na to da interpelacija nije uslov nastanka dužničke docnje. Uslov nastanka dužničke docnje je dužnikova odgovornost za neispunjenje. Kada je ona subjektivna, uslov odgovornosti je dužnikova krivica. Uslov krivice je da je dužnik imao svest o svojoj obavezi (namera i svesni nehat) ili da je morao da ima svest o svojoj obavezi (nesvesni nehat). Interpelacija je tek jedan od načina da se dužnik liši mogućnosti da pozivom na odsustvo svesti negira svoju odgovornost. Međutim, zbog svoje praktičnosti, ona je verovatno bila u praksi najčešće korišćeni način uvođenja elementa svesti u dužnikovu odgovornost, ali to ne menja zaključak da pozivanje dužnika da ispuni prestaciju nije uslov nastanka dužničke docnje. Kada se ne ispuni prestacija iz obligacije zaštićene tužbom bez klauzule ex fide bona, dužnik ne odgovara ukoliko je do neispunjenja došlo usled više sile ili slučaja. Ukoliko je do neispunjenja došlo usled nesvesnog nehata, dužnik ne odgovara za obaveze iz stipulacije, ali odgovara za obaveze iz legata. Kad do neispunjenja dođe usled svesnog nehata ili namere, dužnik je odgovoran. Kada se ne ispuni prestacija iz obligacije zaštićene tužbom sa klauzulom ex fide bona, dužnik ne odgovara ukoliko je do neispunjenja došlo usled više sile. However, due to the fact that it was a very practical means, it was probably the most commonly used way to introduce the element of awareness into debtor’s responsibility. Nevertheless, the conclusion that warning the debtor to fulfill the prestation – interpellatio – is not a condition of mora debitoris stands still. When prestation of an obligation protected by an actio without the ex fide bona clause is unfulfilled, the debtor is not responsible if the unfulfillment is the result of a casus or a vis maior. Ugledna građanska porodica Ćirić iz Sremskih Karlovaca iznedrila je nekoliko izuzetnih intelektualaca. Oni su svojom delatnošću – duhovnom, političkom i kulturnom – ostavili značajnog traga u istoriji srpskog naroda u drugoj polovini 19. i prvoj polovini 20. veka. NJeni najistaknutiji predstavnici bili su: dr Isidor Ćirić (1844-1983), narodno-crkveni i patrijaršijski sekretar, Milan Ćirić (1845-1931), novosadski okružni protoprezviter, zatim Irinej Ćirić (1884-1955), episkop timočki i bački, i Stevan Ćirić (1886-1955), ministar prosvete i predsednik Narodne skupštine Kraljevine Jugoslavije. U radu je predstavljena delatnost najznačajnijih članova porodice koji su, pored širokog obrazovanja, imali i različita interesovanja. Isidor Ćirić je preko dve decenije bio na najvišem činovničkom položaju u Karlovačkoj mitropoliji, ali je istovremeno bio i član Srpskog narodno-crkvenog sabora, kao i poslanik na Hrvatskom i Ugarskom saboru. Bio je aktivan na književnom polju i, zahvaljujući tome, izabran je za člana Književnog odeljenja Matice srpske. NJegov brat Milan je bio dugogodišnji prota Saborne crkve i okružni protoprezviter novosadski. Istovremeno je bio katiheta i član Patronata Novosadske gimnazije, kao i član brojnih eparhijskih tela. Najviše prostora u radu posvećeno je episkopu timočkom i bačkom Irineju, čija je delatnost u međunarodnim crkvenim pokretima, kao predstavnika Srpske pravoslavne crkve u periodu između dva svetska rata, od izuzetnog značaja i do sada gotovo neistražena. NJegova uloga tokom Drugog svetskog rata, kada je pokrenuo i vodio akciju spasavanja više hiljada dece, majki sa odojčadima i starijih iz logora Šarvar, kao i u otvaranju Dečje bolnice u Novom Sadu, bila je od presudnog značaja. Stevan Ćirić je aktivno učestvovao u političkom životu Kraljevine Jugoslavije u periodu od 1934. do 1939, kao ministar prosvete i predsednik Narodne skupštine. Bio je izuzetno angažovan u radu Interparlamentarne unije i Interparlamentarne Male Antante. Istovremen, Notable urban family Ćirić from Sremski Karlovci has given several outstanding intellectuals. With their spiritual, political and cultural activities, they left a significant mark in the history of the Serbian people in the second half of 19th century and the first half of 20th century. This thesis deals with the activities of the most prominent members of the Ćirić family who had shared a variety of interests along with their comprehensive education. Isidor Ćirić held the highest administrative positions in the Metropolitanate of Sremski Karlovci for over two decades, and at the same time, he was a member of the Serbian National and Church Assembly, as well as a member of Croatian and Hungarian Parliament. He was active in the literary field, and for this reason he was chosen to become a member of the Literary Department of Matica Srpska. His brother Milan was a long-term priest of the Assembly Church and Novi Sad county presbyter. At the same time, he was a catechist and a member of the Patronage of Novi Sad Grammar School, as well as a member of numerous eparchial administrative bodies. The biggest section of the thesis is dedicated to Bishop of Timok and Bishop of Bačka, Irinej, whose activity in the international church movements, as the representative of the Serbian Orthodox Church in the period between the two world wars, was immensely important and has been barely investigated so far. Predmet doktorske disertacije je rad dva vanredna suda – Črezvičajnog suda nad buntovnicima (1839) i Prekog suda formiranog povodom Katanske bune (1844). Prvi je formiran pošto je propala Jovanova buna, koju je podstakao knez Miloš Obrenović (1815–1839, 1858–1860) s ciljem da oslabi uticaj svojih protivnika u Državnom savetu i vaspostavi svoju apsolutnu vlast. Formiranju Črezvičajnog suda prethodila je istraga protiv osumnjičenih za učešće u buni, koju su vodile čak četiri istražne komisije. One su tokom svog rada koristila sledeća dokazna sredstva: priznanja okrivljenih, suočenja okrivljenih, svedoke, suočenja okrivljenih i svedoka i pisane isprave. Črezvičajni sud počeo je sa radom 25. jula 1839. I on je sproveo dokazni postupak, u kojem su korišćena manje-više ista dokazna sredstva. Katanska buna, događaj koji je predstavljao povod za formiranje drugog vanrednog suda, predstavlja neuspeli pokušaj pristalica dinastije Obrenović da obore ustvaobraniteljski režim, odigrao se između 22. i 25. septembra 1844. Protiv nekih od zarobljenih buntovnika istragu su vodili Toma Vučić Perišić, komandant vojske upućene da uguši pobunu, i Stevan Novaković, sudija šabačkog okružnog suda. Istražni postupak, i to protiv svih okrivljenih vodio je i sam Preki sud. Organizatori i predvodnici bune osuđeni su na smrt, oni koji su znali za bunu pre njenog izbijanja, a to nisu prijavili vlastima, na doživotnu robi, The subject of this doctoral dissertation are two irregular courts – Irregular Court for Rebels (1839) and Martial Court formed on the occasion of Katanska Rebellion (1844). The first of these two courts was formed after Jovan’s rebellion, incited by Prince Miloš Obrenović (1815–1839, 1858–1860) with the goal of weakening the authority of his opponents in State Council and renewal of the ruler’s absolute power, had been quenched. Antecedent of the Irregular Court’s establishment, four investigation boards had undertaken the investigation against the persons suspected of participation in Jovan’s Rebellion. In the course of the inquiry the boards produced following evidence: suspects’ confessions, confrontations of suspects, witnesses, confrontations of suspects with witnesses and documentary evidence. Irregular Court commenced its work on July 25th 1839. This institution also performed production of evidence, during which more or less above-cited sorts of evidence were produced. After the evidence had been shown, Irregular Court turned to deliberation. Less important suspects were either acquitted or sentenced to mild punishments, as those who Irregular Court found organizers and instigators of Jovan’s Rebellion are condemned to multiyear prison sentences. The convicts of less significance were pardoned while Irregular Court’s activity was still in progress. Not long after, more important convicts were granted pardon as well. Katane (Hussars)’s Rebellion, the event that occasioned the formation of the second irregular court, represents an unsuccessful attempt of Obrenović dynasty's followers to overthrow Constitution-Defenders' regime. The inquiry against some of the suspects was conducted by Toma Vučić Perišić, the commander of the troops sent to put down Katane's Rebellion, and Stevan Novaković, a judge of Šabac District Court. Из оваквог одређења појма проистиче да је за њен настанак неопходно да се кумулативно оствари пет услова. Дужничка доцња утиче на перпетуацију облигације утолико што проширује круг случајева у којима до ње може да дође. Овај утицај већ је садржан у последици дужничке доцње – преласку ризика од немогућности испуњења престације настале случајем или вишом силом са повериоца на дужника. И пре и после настанка дужничке доцње, до перпетуације долази када је дужник одговоран за немогућност испуњења престације. Разлика је у томе што за немогућност испуњења престације, пре настанка доцње дужник одговара ако је он или лице, односно ствар, за коју је одговоран проузроковала немогућност, док након падања у доцњу, он одговара, поред дотадашњих разлога, и за немогућност испуњења престације до које је дошло случајем или вишом силом.За разлику од перпетуације облигације, последице дужничке доцње биле су прелазак ризика од настанка штете неиспуњењем престације са повериоца на дужника, прелазак ризика од немогућности испуњења престације настале случајем или вишом силом са повериоца на дужника и настанак дужникове обавезе за коју је претходно уговорено да дужничка доцња за њу представља одложни услов.Чишћење доцње могло је да наступи деловањем како повериоца, тако и дужника. Задоцнели дужник могао је да очисти доцњу испуњењем примарне престације и санирањем евентуално настале штете, исплатом евентуалних затезних камата или уговорне казне. Upravo ovakav pristup bio je uvod u razvoj tzv. utilitetnog načela tokom postklasičnog perioda rimskog prava.Drugo od dva u literaturi najspornija jeste pitanje da li je pretvaranje obligacije u trajnu - perpetuatio obligationis – posledica dužničke docnje. Da bi se perpetuacija obligacije smatrala posledicom dužničke docnje, dužnička docnja bi morala da bude njen uzrok. Uzrokom neke pojave smatra se okolnost koja je nužna i dovoljna za njen nastanak. Međutim, da bi došlo do pretvaranja obligacije u trajnu, zadocnjenje u ispunjenju prestacije niti je nužna, niti je dovoljna okolnost. Dužnička docnja utiče na perpetuaciju obligacije utoliko što proširuje krug slučajeva u kojima do nje može da dođe. Ovaj uticaj već je sadržan u posledici dužničke docnje – prelasku rizika od nemogućnosti ispunjenja prestacije nastale slučajem ili višom silom sa poverioca na dužnika. I pre i posle nastanka dužničke docnje, do perpetuacije dolazi kada je dužnik odgovoran za nemogućnost ispunjenja prestacije. Razlika je u tome što za nemogućnost ispunjenja prestacije, pre nastanka docnje dužnik odgovara ako je on ili lice, odnosno stvar, za koju je odgovoran prouzrokovala nemogućnost, dok nakon padanja u docnju, on odgovara, pored dotadašnjih razloga, i za nemogućnost ispunjenja prestacije do koje je došlo slučajem ili višom silom.Za razliku od perpetuacije obligacije, posledice dužničke docnje bile su prelazak rizika od nastanka štete neispunjenjem prestacije sa poverioca na dužnika, prelazak rizika od nemogućnosti ispunjenja prestacije nastale slučajem ili višom silom sa poverioca na dužnika i nastanak dužnikove obaveze za koju je prethodno ugovoreno da dužnička docnja za nju predstavlja odložni uslov.Čišćenje docnje moglo je da nastupi delovanjem kako poverioca, tako i dužnika. Firstly, culpa lata was inserted in the scope of responsibility, followed by negligence in general, mostly in the obligations from which debtor benefited. This approach was exactly the thing that led to the development of the so-called utility principle during the postclassic period of Roman law.The second of the two most controversial issues in the literature is the question whether perpetuatio obligationis is a consequence of mora debitoris. In order for perpetuatio to be a consequence of mora debitoris, mora debitoris would would have to be its cause. A cause of an object is a necessary and sufficient circumstance of its occurrence. However, mora debitoris is neither of those for perpetuatio obligationis. Mora debitoris affects perpetuatio obligationis by merely broadening the scope of circumstances in which it can occur. This effect is already contained by one of the consequences of mora debitoris, namely – the transfer of risk of the impossibility of prestation fulfillment caused by casus or vis maior from the creditor to the debtor. Both prior and posterior to the beginning of mora debitoris, debtor’s responsibility is what causes the perpetuatio obligationis. The difference is that prior to mora, the debtor is responsible if he himself, or a person or a thing for which he is generally responsible, cause the impossibility, while posterior to it, he is responsible, apart from the aforementioned, for the impossibility caused by casus or vis maior.Unlike perpetuatio obligationis, the consequences of mora debitoris were transfer of risk of the occurrence of damages caused by casus or vis maior from the creditor to the debtor, transfer of risk of the impossibility of prestation fulfillment caused by casus or vis maior from the creditor to the debtor as well as the occurrence of debtor’s obligation for which it had been previously agreed that mora debitoris would present its suspensive condition.

Foreign fighters, that is, individuals who travel to a foreign country in order to join an armed conflict there, have existed throughout history. International law was neutral to this phenomenon, neither forbidding, nor allowing it. In the last decade, however, foreign fighting started being observed almost exclusively within the context of terrorism. This is due to the fact that in the 2010s a great number of individuals travelled to Syria and Iraq in order to support ISIS or other armed groups. As a response to this, the UN Security Council adopted several resolutions referring to “foreign terrorist fighters” and formulating legal response to fight them. The most significant Resolution in this regard is the Resolution 2178 from 2014, which imposes an obligation on the UN member states to adapt their legislation so to treat some forms of foreign fighting as terrorism. The Resolution specifically requires that member states adapt their laws in order to prosecute and penalize their nationals who travel or attempt to travel to a foreign state in order to perpetrate, plan or prepare, or participate in, terrorist acts or to provide or receive terrorist training, including in connection with armed conflict. In addition, the Resolution imposes an obligation on individuals, demanding that all foreign terrorist fighters disarm and cease all terrorist acts and participation in armed conflict. The Resolution 2178 was controversial in several aspects. First, unlike other Security Council resolutions, which normally address UN member states, this Resolution addresses not only states but individuals as well. The question then arose of whether the Resolution created international individual obligations. Second, the Security Council was criticized for acting ultra vires by exercising legislative powers in the Resolution. It has been maintained that legislating by the Security Council is contrary to the division of powers between the Council and the General Assembly and that it results in neglecting one of the basic principles of international law – the one providing that states are bound only by those rules to which they consent. Thirdly, the Resolution has been criticized for imposing an obligation to criminalize certain terrorist acts without defining what terrorism is. Criminalization of terrorist acts in the absence of the definition of terrorism may lead to abuse, in sense that states, in particular those with oppressive regimes, may characterize as terrorism any act that they find undesirable. In the years following the adoption of the Resolution 2178, the Security Council adopted several other resolutions dealing with foreign terrorist fighters. However, it was not until 2017 and the collapse of ISIS that the more significant resolutions addressing the issue were adopted. The return of foreign terrorist fighters to their states of origin inspired the adoption of the resolutions 2368 and 2396, which dealt with the issue of returnees and relocators. These resolutions put an emphasis on the inter-state cooperation and information sharing, as well as on undertaking different measures such as asset freeze, arms embargo and travel bans, developing databases of known and suspect terrorists and others. All of the mentioned resolutions have created a legal framework for responding to the phenomenon of foreign terrorist fighters. This has resulted in a kind of “layering” of foreign fighters: on the one side there are foreign terrorist fighters, and on the other side there are all the other foreign fighters. International law remains neutral to the latter, but is no longer neutral to the former. What are the reasons behind differentiating legal response towards foreign terrorist fighters from the one towards other foreign fighters? The first reason is, no doubt, the fight against terrorism, which is nowadays more intense than it used to be in the past. And second, foreign fighting takes place in states other than the home state and foreign fighters are a threat to those states in which fighting takes place. On the other hand, foreign terrorist fighters often return to their home states, usually more radicalized and more experienced than they were upon their departure. It is, therefore, a fear of those returnees that inspired the adoption of the relevant Security Council Resolutions. UN member states are currently facing various challenges in implementing the said Resolutions. Some of them lack technical ability to implement required measures, while some of them lack political will. There is also, quite expectedly, an old problem of reconciling counter-terrorism measures with the protection of human rights

The topic of the trust that citizens express in the institutions and organizations of that society occupies an important place in sociological theories and research during the last few decades. Whether these theories analyze trust as an important dimension of civic culture (Almond and Verba), as an essential dimension of social and cultural capital (Putnam), as a characteristic of late modernity (Giddens), as a characteristic of the "cultures of trust, or cultures of distrust" (Sztompka) etc., what they all have in common is emphasizing and analyzing the phenomenon of trust as important for the functioning and development of society and democratic systems, for participation in the political processes of representative democracies, development of civic culture (political and legal culture), solidarity, cooperation, tolerance, etc. In this regard, this paper focuses on the analysis of the degree of trust that Croatian citizens express in trade unions as collective worker's organizations and civil society organizations, but with special emphasis on young people in Croatia. Namely, starting from the review and analysis of the results on the level of trust of young people in trade unions collected within some of the scientific research about youth in Croatia, the aim of this paper is to analyze and emphasize the results of three recent research about legal and political literacy of youth, from which we will emphasize data on the trust that young people express towards trade unions, on the knowledge of collective labour rights as well as on the knowledge of trade unions and their activities. The first research is a survey on the perception of the students in Croatia about trade unions conducted during 2012 on a convenience sample of 620 final year students at 13 different faculties of the University of Zagreb (Vidović and Rimac, 2013). The collected data indicate a low level of knowledge of trade unions and their activities among university students who participated in the survey, as well as a low level of knowledge of how unions are organized, and what is their purpose (Vidović and Rimac, 2013). Besides, the results emphasize the existence of relatively negative perceptions of students about the role that trade unions play in Croatia, as well as relatively positive perceptions of students about the usefulness of trade unions (Vidović and Rimac, 2013). The second research is a survey about the knowledge of selected labour rights among vocational school graduates in Croatia (Jeknić and Čop, 2021). The survey was conducted during 2019 on a convenience sample of 1102 graduates from 54 vocational schools in Croatia, as a part of the EU - project “With Knowledge to Law” (UP.04.2.1.03.0013). The collected data indicate a low level of knowledge of selected collective labour rights among research participants, as well as a low level of knowledge of trade union activities (Jeknić and Čop, 2021). Besides, 62.9% of the research participants express low level of trust in trade unions in Croatia (37.5% of graduates have little trust in trade unions, while 25.4% have no trust at all) ; while 10.8% of the research participants express high level of trust in trade unions in Croatia (8.5% of graduates have a lot of trust in trade unions, while only 2.3% of them have very high trust in trade unions). The third research is a survey about political literacy, conducted during 2021 on a representative sample of 1122 high school graduates from 59 high schools in Croatia (Baketa, Bovan and Matić Bojić, 2021). Participants of this research are mostly unsure and undecided about their trust in trade unions (47.5% of graduates), while 19.6% do not trust trade unions at all, 19.7% mostly do not trust, 12.3% mostly trust, and only 1.0% fully trust trade unions (Baketa et al., 2021). Presented results are not comparable but analyzing them in the context of legal and political literacy of young people as an integral part of their civic competencies, and contemporary European debates on youth attitudes towards trade unions and the promotion of social interaction between trade unions and young people (Hodder and Vandaele, 2019), results of these studies may have application value in the development of curricula for civic education at different educational levels, as well as for the development and planning of trade union activities in Croatia, especially regarding the recruitment of new members. Given the decline in trade union density (from about 38% in 2000 to about 25% in 2016), and decline in collective bargaining coverage (from around 65% in 2000 to around 53% in 2016) (Bagić, 2019), recruitment of new members is one of the key challenges for the trade unions in Croatia.

In the year 2020, the international community is celebrating the 15th anniversary of the adoption of an international norm, which aims at effective protection of the population (children included) from genocide, war crimes, crimes against humanity, and ethnic cleansing. That norm is known as the responsibility to protect or RtoP. Born out of a commitment of state leaders in 2005, it represents shared responsibility of both the states concerned and international community. The primary responsibility lies in the hands of states and their governments. They have to ensure an adequate response to atrocity crimes through a myriad of national actions (e.g., supporting humanitarian assistance, implementing legislative or policy reforms, ensuring effective justice system for prosecuting those responsible, etc.). However, when the state is unwilling or unable to fulfil its responsibility, the role of international community is clearly emphasized. It has the responsibility to encourage states to meet their RtoP and the responsibility to use appropriate diplomatic, humanitarian, and other peaceful means or to take collective action through the UN Security Council, in accordance with the UN Charter. It employs the cooperation of many factors – the UN member states, institutional and comparative advantage of the UN system, regional and sub-regional organizations and arrangements, human rights associations, civil society, etc. Keeping all this in mind, it seems that the international community has effective tools in dealing with atrocity crimes. In the year 2020, the international community proudly emphasizes progress achieved in the last three decades with regards to the protection of children’s rights in armed conflicts. One may say that the framework of protection has been developed since the adoption of the Convention for the Rights of the Child (1989), its Optional Protocol on the involvement of children in armed conflict (2000), through the Security Council Resolution 1612(2005), initiation, and implementation of the Monitoring and Reporting Mechanism, establishment of the Special Representative of the Secretary-General for Children and Armed Conflict, and the Security Council Working Group for Children and Armed Conflict, etc. It seems that the framework for the protection of children trapped in conflict- related environment has become strong and productive. On the other hand, an estimated 420 million children live in a conflict zone. Nearly 31 million children have been forcibly displaced from their homes. 13 million children have left their countries as refugees. The picture of the child caught within the armed conflict has become its common feature ; the most memorable picture in many situations. Children live their lives in the center of conflicts, not only as bystanders, but as the direct targets and victims. The humanity is still witnessing too many crimes that have been committed against children. Grave violations that can be committed against children in contemporary armed conflicts are divided into six categories: killing and maiming of children, recruitment of children or their use as soldiers, sexual violence against children, their abduction, attacks against schools and hospitals, and denial of humanitarian access for children. According to recent reports, more than 24, 000 grave violations against children were verified and confirmed in 2018. That number has nearly tripled since 2010. It seems that neither RtoP nor the framework for protecting children is efficient. Who is to blame? Who is responsible for the mere fact that millions of children suffer from the consequences of armed conflicts worldwide? Keeping in mind the development of human rights and the commitment of state leaders in 2005 World Summit – the situation seems to be quite clear ; it has to employ shared responsibility of the state(s) concerned and international community. Protection of children in armed conflicts, while implementing the RtoP norm, could be considered as one of the most important challenges of the international community nowadays. Its development has been characterized by the joint action of different international actors, led by the UN. Their endeavors have led to the establishment of some special bodies, programs and actions, the purpose of which is a more significant contribution and more effective protection of children in armed conflicts. However, the mechanism aimed at the prevention or reduction of grave violations can only be as powerful and effective as its implementation on the ground. The idea behind this topic proposal is to offer an analysis of the framework of that cooperation in respect of the RtoP norm – what has been done so far and has it been done in the most effective manner?

Mirroring the basic tenets of a classical continental order, Croatia's legal tradition suffered two major challenges anent its 2013 accession to the EU. The first, already introduced in a lesser scope in 1998 by the ratification and implementation of the European Convention on Human Rights, pertained to the flexibilization of Croatia's negation of courts as loci of independent creation of law. The EU's precedential system, whereby case-law of the ECJ functions as an autonomous, quasi-constitutional source of law, intervened in such a setup of the Croatian constitutional review system, requiring that the combined effect of the (at least doctrinally!) well-established principles of supremacy (including in its procedural aspect, known as the „Simmenthal doctrine“) and direct effect be that a national judge is free to disregard a domestic source of law in favour of a contrary European norm (even a judge-made one). Such expected occurrences then naturally lead to the second challenge, namely the potential of such application of EU law to be on a collision course with the so called „constitutional identity“ of the Croatian state, inspired by the jurisprudence of the German and other European constitutional courts and recognized by the Croatian Constitutional Court since 2011. Defining the constitutional, and therefore national DNA of a people, the right to dispose of such identity does not and cannot reside in any constitutional organ of the state, including in the Croatian people (through referenda), and cannot be amenable to change by application of the supremacy doctrine. This especially holds regarding the potential that such a super- imposition of a foreign legal order on nationally established standards of protection of fundamental rights and freedoms could lower those standards, since a pan-European levelling of protection of the same (in the name of uniformity and effectiveness of EU law) could in our national case level them down. This is especially true due to the nexus between the EU’s Charter of Fundamental Rights (EU’s rights catalogue) and the ECHR (a pan-European “floor” of rights as a minimum common denominator of rights’ protection), whereby a right contained in the former and corresponding to a right in the latter will be applied as if their scope and meaning were the same. Building on Croatian experience with implementation of the ECHR and considering other EU nations’ responses to similar challenges, we suggest that this potential risk of a Croatian-EU jurisdictional clash be attenuated by accommodating the peculiarities of the EU system in a way that would simultaneously honour Croatian obligations under the Lisbon Treaty and protect national constitutional identity. Relying on comparative constitutional law, we suggest a system of dual preliminarity, which would launch interlocutory procedures before both the ECJ and the Croatian Constitutional Court, and work best to extract a national judge from the non-enviable position of a „double agent“ of the national and EU founding documents. Such a system would allow for the greatest possible mutual constitutional accommodation of the two orders, even if always cognizable of the fact that an irreconcilable difference between the two orders would, in ultima linea, have to be resolved in line with the Croatian tradition of constitutional supremacy and primacy of national safeguards of fundamental rights' protection.

Угледна грађанска породица Ћирић из Сремских Карловаца изнедрила је неколико изузетних интелектуалаца. Они су својом делатношћу – духовном, политичком и културном – оставили значајног трага у историји српског народа у другој половини 19. и првој половини 20. века. Њени најистакнутији представници били су: др Исидор Ћирић (1844-1983), народно-црквени и патријаршијски секретар, Милан Ћирић (1845-1931), новосадски окружни протопрезвитер, затим Иринеј Ћирић (1884-1955), епископ тимочки и бачки, и Стеван Ћирић (1886-1955), министар просвете и председник Народне скупштине Краљевине Југославије. У раду је представљена делатност најзначајнијих чланова породице који су, поред широког образовања, имали и различита интересовања. Исидор Ћирић је преко две деценије био на највишем чиновничком положају у Карловачкој митрополији, али је истовремено био и члан Српског народно-црквеног сабора, као и посланик на Хрватском и Угарском сабору. Био је активан на књижевном пољу и, захваљујући томе, изабран је за члана Књижевног одељења Матице српске. Његов брат Милан је био дугогодишњи прота Саборне цркве и окружни протопрезвитер новосадски. Истовремено је био катихета и члан Патроната Новосадске гимназије, као и члан бројних епархијских тела. Највише простора у раду посвећено је епископу тимочком и бачком Иринеју, чија је делатност у међународним црквеним покретима, као представника Српске православне цркве у периоду између два светска рата, од изузетног значаја и до сада готово неистражена. Његова улога током Другог светског рата, када је покренуо и водио акцију спасавања више хиљада деце, мајки са одојчадима и старијих из логора Шарвар, као и у отварању Дечје болнице у Новом Саду, била је од пресудног значаја. Стеван Ћирић је активно учествовао у политичком животу Краљевине Југославије у периоду од 1934. до 1939, као министар просвете и председник Народне скупштине. Био је изузетно ангажован у раду Интерпарламентарне уније и Интерпарламентарне Мале Антанте. Истовремено је био председник Југословенског шаховског савеза, члан Матице српске, Ротари клуба и многих других удружења. Кроз историју породице Ћирић може се сагледати и друштво у целини у одређеном историјском периоду. Породица Ћирић је добар пример угледне грађанске породице која је изнедрила неколико значајних личности које су заузимале важне положаје у друштву. Ugledna građanska porodica Ćirić iz Sremskih Karlovaca iznedrila je nekoliko izuzetnih intelektualaca. Oni su svojom delatnošću – duhovnom, političkom i kulturnom – ostavili značajnog traga u istoriji srpskog naroda u drugoj polovini 19. i prvoj polovini 20. veka. NJeni najistaknutiji predstavnici bili su: dr Isidor Ćirić (1844-1983), narodno-crkveni i patrijaršijski sekretar, Milan Ćirić (1845-1931), novosadski okružni protoprezviter, zatim Irinej Ćirić (1884-1955), episkop timočki i bački, i Stevan Ćirić (1886-1955), ministar prosvete i predsednik Narodne skupštine Kraljevine Jugoslavije. U radu je predstavljena delatnost najznačajnijih članova porodice koji su, pored širokog obrazovanja, imali i različita interesovanja. Isidor Ćirić je preko dve decenije bio na najvišem činovničkom položaju u Karlovačkoj mitropoliji, ali je istovremeno bio i član Srpskog narodno-crkvenog sabora, kao i poslanik na Hrvatskom i Ugarskom saboru. Bio je aktivan na književnom polju i, zahvaljujući tome, izabran je za člana Književnog odeljenja Matice srpske. NJegov brat Milan je bio dugogodišnji prota Saborne crkve i okružni protoprezviter novosadski. Istovremeno je bio katiheta i član Patronata Novosadske gimnazije, kao i član brojnih eparhijskih tela. Najviše prostora u radu posvećeno je episkopu timočkom i bačkom Irineju, čija je delatnost u međunarodnim crkvenim pokretima, kao predstavnika Srpske pravoslavne crkve u periodu između dva svetska rata, od izuzetnog značaja i do sada gotovo neistražena. NJegova uloga tokom Drugog svetskog rata, kada je pokrenuo i vodio akciju spasavanja više hiljada dece, majki sa odojčadima i starijih iz logora Šarvar, kao i u otvaranju Dečje bolnice u Novom Sadu, bila je od presudnog značaja. Stevan Ćirić je aktivno učestvovao u političkom životu Kraljevine Jugoslavije u periodu od 1934. do 1939, kao ministar prosvete i predsednik Narodne skupštine. Bio je izuzetno angažovan u radu Interparlamentarne unije i Interparlamentarne Male Antante. Istovremeno je bio predsednik Jugoslovenskog šahovskog saveza, član Matice srpske, Rotari kluba i mnogih drugih udruženja. Kroz istoriju porodice Ćirić može se sagledati i društvo u celini u određenom istorijskom periodu. Porodica Ćirić je dobar primer ugledne građanske porodice koja je iznedrila nekoliko značajnih ličnosti koje su zauzimale važne položaje u društvu. Notable urban family Ćirić from Sremski Karlovci has given several outstanding intellectuals. With their spiritual, political and cultural activities, they left a significant mark in the history of the Serbian people in the second half of 19th century and the first half of 20th century. Its most prominent members were: dr Isidor Ćirić (1844-1893), the Secretary of Patriarchate and the National Church Secretary, Milan Ćirić (1845-1931), Novi Sad county presbyter, Irinej Ćirić (1884-1955), Bishop of Timok and Bishop of Bačka, and Stevan Ćirić (1886-1955), the Minister of Education and the President of the National Assembly of the Kingdom of Yugoslavia. This thesis deals with the activities of the most prominent members of the Ćirić family who had shared a variety of interests along with their comprehensive education. Isidor Ćirić held the highest administrative positions in the Metropolitanate of Sremski Karlovci for over two decades, and at the same time, he was a member of the Serbian National and Church Assembly, as well as a member of Croatian and Hungarian Parliament. He was active in the literary field, and for this reason he was chosen to become a member of the Literary Department of Matica Srpska. His brother Milan was a long-term priest of the Assembly Church and Novi Sad county presbyter. At the same time, he was a catechist and a member of the Patronage of Novi Sad Grammar School, as well as a member of numerous eparchial administrative bodies. The biggest section of the thesis is dedicated to Bishop of Timok and Bishop of Bačka, Irinej, whose activity in the international church movements, as the representative of the Serbian Orthodox Church in the period between the two world wars, was immensely important and has been barely investigated so far. He had a key role in the World War Two, when he organized and led the action of saving several thousand children, mothers with infants and the elderly from the concentration camp Sárvár and when he helped the opening of the Children’s Hospital Ward in Novi Sad. Stevan Ćirić actively participated in the political life of the Kingdom of Yugoslavia in the period from 1934 to 1939, as the Minister of Education and the President of the National Assembly. He was extremely active in the work of Inter-parliamentary Union and Inter-parliamentary Little Entente. At the same time, he was the president of the Yugoslav Chess Association, a member of Matica Srpska, Rotary Club and many other societies. Throughout the history of the Ćirić family we can get an insight into the life of a society as a whole in a certain historic period. The Ćirić family is a good example of a notable urban family which gave several prominent figures who assumed high positions in the society.

Предмет докторске дисертације је рад два ванредна суда – Чрезвичајног суда над бунтовницима (1839) и Преког суда формираног поводом Катанске буне (1844). Први је формиран пошто је пропала Јованова буна, коју је подстакао кнез Милош Обреновић (1815–1839, 1858–1860) с циљем да ослаби утицај својих противника у Државном савету и васпостави своју апсолутну власт. Формирању Чрезвичајног суда претходила је истрага против осумњичених за учешће у буни, коју су водиле чак четири истражне комисије. Оне су током свог рада користила следећа доказна средства: признања окривљених, суочења окривљених, сведоке, суочења окривљених и сведока и писане исправе. Чрезвичајни суд почео је са радом 25. јула 1839. И он је спровео доказни поступак, у којем су коришћена мање-више иста доказна средства. Пошто су изведени докази, Чрезвичајни суд је приступио доношењу пресуда. Мање важни окривљени су или ослобођени кривице или осуђени на благе казне, док су они за које је Чрезвичајни суд устанио да су били покретачи и организатори буне осуђени на вишегодишње казне лишења слободе. Мање важни осуђени помиловани су још за време рада Чрезвичајног суда, да би недуго након тога уследило и помиловање важнијих осуђеника. Катанска буна, догађај који је представљао повод за формирање другог ванредног суда, представља неуспели покушај присталица династије Обреновић да оборе устваобранитељски режим, одиграо се између 22. и 25. септембра 1844. Против неких од заробљених бунтовника истрагу су водили Тома Вучић Перишић, командант војске упућене да угуши побуну, и Стеван Новаковић, судија шабачког окружног суда. Истражни поступак, и то против свих окривљених водио је и сам Преки суд. Сем доказних средстава наведених у излагању о Чрезвичајном суду, у истрази коју је водио Преки суд употребљавано је и јемство представника власти за окривљене. Организатори и предводници буне осуђени су на смрт, они који су знали за буну пре њеног избијања, а то нису пријавили властима, на доживотну робију, лица која су се придружила бунтовницима на казне лишења слободе у различитом трајању, а они који су искористили метеж настао побуном за крађе на телесне казне или затвор од две године. У току 1845. и 1846. један број осуђених ослобођен је даљег издржавања казне, а неким осуђеницима казне су ублажене. Међутим, већина осуђених наставила је да издржава казне по слову пресуда Преког суда. Разлог због којег је Преки суд био строжи него Чрезвичајни суд лежи у политичким околностима у којима су они деловали. Противници кнеза Милоша 1839. нису имали подршку у народу и због тога нису смели строгим кажњавањем да одвраћају потенцијалне присталице од себе. С друге стране, 1844. није постојала реална опасност од повратка Обреновића на српски престо. То је омогућило уставобранитељској власти да много строже казни покушај обреновићевске реакције. Predmet doktorske disertacije je rad dva vanredna suda – Črezvičajnog suda nad buntovnicima (1839) i Prekog suda formiranog povodom Katanske bune (1844). Prvi je formiran pošto je propala Jovanova buna, koju je podstakao knez Miloš Obrenović (1815–1839, 1858–1860) s ciljem da oslabi uticaj svojih protivnika u Državnom savetu i vaspostavi svoju apsolutnu vlast. Formiranju Črezvičajnog suda prethodila je istraga protiv osumnjičenih za učešće u buni, koju su vodile čak četiri istražne komisije. One su tokom svog rada koristila sledeća dokazna sredstva: priznanja okrivljenih, suočenja okrivljenih, svedoke, suočenja okrivljenih i svedoka i pisane isprave. Črezvičajni sud počeo je sa radom 25. jula 1839. I on je sproveo dokazni postupak, u kojem su korišćena manje-više ista dokazna sredstva. Pošto su izvedeni dokazi, Črezvičajni sud je pristupio donošenju presuda. Manje važni okrivljeni su ili oslobođeni krivice ili osuđeni na blage kazne, dok su oni za koje je Črezvičajni sud ustanio da su bili pokretači i organizatori bune osuđeni na višegodišnje kazne lišenja slobode. Manje važni osuđeni pomilovani su još za vreme rada Črezvičajnog suda, da bi nedugo nakon toga usledilo i pomilovanje važnijih osuđenika. Katanska buna, događaj koji je predstavljao povod za formiranje drugog vanrednog suda, predstavlja neuspeli pokušaj pristalica dinastije Obrenović da obore ustvaobraniteljski režim, odigrao se između 22. i 25. septembra 1844. Protiv nekih od zarobljenih buntovnika istragu su vodili Toma Vučić Perišić, komandant vojske upućene da uguši pobunu, i Stevan Novaković, sudija šabačkog okružnog suda. The subject of this doctoral dissertation are two irregular courts – Irregular Court for Rebels (1839) and Martial Court formed on the occasion of Katanska Rebellion (1844). The first of these two courts was formed after Jovan’s rebellion, incited by Prince Miloš Obrenović (1815–1839, 1858–1860) with the goal of weakening the authority of his opponents in State Council and renewal of the ruler’s absolute power, had been quenched. Antecedent of the Irregular Court’s establishment, four investigation boards had undertaken the investigation against the persons suspected of participation in Jovan’s Rebellion. In the course of the inquiry the boards produced following evidence: suspects’ confessions, confrontations of suspects, witnesses, confrontations of suspects with witnesses and documentary evidence. Irregular Court commenced its work on July 25th 1839. This institution also performed production of evidence, during which more or less above-cited sorts of evidence were produced. After the evidence had been shown, Irregular Court turned to deliberation. Less important suspects were either acquitted or sentenced to mild punishments, as those who Irregular Court found organizers and instigators of Jovan’s Rebellion are condemned to multiyear prison sentences. The convicts of less significance were pardoned while Irregular Court’s activity was still in progress. Not long after, more important convicts were granted pardon as well. Katane (Hussars)’s Rebellion, the event that occasioned the formation of the second irregular court, represents an unsuccessful attempt of Obrenović dynasty's followers to overthrow Constitution-Defenders' regime. The inquiry against some of the suspects was conducted by Toma Vučić Perišić, the commander of the troops sent to put down Katane's Rebellion, and Stevan Novaković, a judge of Šabac District Court. Martial Court also carried out investigations, of which all suspects were subjects. Besides evidence mentioned in previous paragraph, vouchments for a suspects' moral integrity and rightful political attitude, given by the representatives of local authorities, were also used in the proceedings led by Martial Court. The organizers and instigators of Katane's Rebellion were sentenced to death, the persons who knew that the rebellion would break out and did not report it to the authorities were condemned to perpetual forced labor, the individuals who joined the rebells were sentenced to prison whose duration varied. The people who used Rebellion-provoked tumultation to commit thefts and burgalries were, according to verdicts of Court Martial, to undertake corporal punishments or two-year prison. In 1845 and 1846 a certain number of convicts was pardonned, as some sentences were mitigated. Nevertheless, most of them were not granted pardon. The reason of Martial Court's greater harshness in comparison with Irregular Court lies in political circumstances in which the two institutions worked. Prince Miloš’opponents were not favorite among the people. Therefore they did not want to even more deteriorate their low popularity by admitting Irregular Court to pronounce severe punishments. On the other hand, in 1844 Obrenovićs’ partisans were not serious threat to Constitution-Defenders regime. It enabled power-holders to punish an attempt of Obrenović’s reaction more severely.

Предмет докторске дисертације је рад два ванредна суда – Чрезвичајног суда над бунтовницима (1839) и Преког суда формираног поводом Катанске буне (1844).
