The article examines the principle of international criminal justice - the presumption of innocence of the defendant. Its content, limits are clarified, the practice of the European Court of Human Rights is analyzed, as well as the practice of international tribunals on the presumption of innocence of the defendant as part of his right to a fair trial.It is established that presumptions of a legal nature on matters of fact and law are admissible in international criminal proceedings only if the defendant is given the opportunity to refute them and prove his innocence.The presumption of innocence is enshrined as a principle and right of the defendant in modern international criminal procedure law, primarily in the Statutes of international courts and tribunals. An analysis of the relevant provisions of these statutes shows that the presumption of innocence means at least that: 1) the burden of proof lies on the prosecution; 2) evidence of guilt must meet a certain standard; 3) in some cases, the presumption may include additional rights, such as the right to bail, as well as additional conditions, such as the condition of a guilty plea only by a lawful court or following a trial in which all rights of defense have been secured, etc. .; 4) the defendant has the right to doubt in his favor; 5) the right of the defendant to remain silent; 6) the right of the defendant to a certain standard of conviction or acquittal; 7) theright of the defendant to compensation in case of acquittal. The formulation of the presumption of innocencein the Covenant and the Convention allows the establishment of the innocence of the defendant by different procedures depending on “what is at stake”, ie depending on the legal consequences arising from the establishment of guilt. If the defendant can be released from criminal liability and punishment, the procedure for rebutting the presumption of his innocence may be different, and the defendant, of course, must be provided with all means of protection against prosecution., У статті досліджується принцип міжнародного кримінального судочинства – презумпція невинуватості підсудного. З’ясовується її зміст, межі, аналізується практика Європейського Суду з прав людини, а також практика міжнароднихтрибуналів щодо презумпції невинуватості підсудного, як складової частини його права на справедливий суд.Встановлено, презумпції юридичного характеру з питань факту та права припустимі в міжнародному кримінальному процесі, тільки якщо підсудному дається можливість спростувати їх і довести свою невинуватість.Презумпція невинуватості закріплюється в якості принципу та права підсудного в сучасному міжнародному кримінально-процесуальному праві, насамперед у Статутах міжнародних судів та трибуналів. Аналіз відповідних положень цих статутів показує, що презумпція невинуватості як мінімум означає, що: 1) тягар доказів лежить наобвинуваченні; 2) докази провини повинні відповідати певному стандарту; 3) у ряді випадків презумпція може включати додаткові права, наприклад, право на звільнення під заставу, а також додаткові умови, наприклад умова рішенняпро визнання вини лише законним судом або за підсумками процесу, на якому були забезпечені всі права захисту, і т.д.; 4) підсудний має право на сумніви в свою користь; 5) право підсудного зберігати мовчання; 6) право підсудного на пев-ний стандарт обвинувального або виправдувального вироку; 7) право підсудного на компенсацію в разі виправдання.Формулювання презумпції невинуватості в Пакті і Конвенції, дозволяє встановлювати невинуватість підсудного різними процедурами в залежності від того, «що поставлено на карту», тобто в залежності від правових наслідків, щовипливають з встановленням вини. Якщо підсудний може бути звільнений від кримінальної відповідальності та покарання, то процедура спростування презумпції його невинуватості може бути й іншою, при цьому підсудному, безумовно, повинні бути надані всі засоби захисту від обвинувачення.

Twenty years ago, the International Criminal Court (hereinafter ICC or the Court) was established holding the aim of placing victims at the heart of international criminal justice proceedings and delivering justice to them through, among others, reparations. Article 75 of the Rome Statute lays out the reparations regime, and, in practice, court-ordered reparations are a means of delivering such justice. Focusing on Court decisions on reparations, our analysis takes stock of all developments before the ICC and attempts to highlight the mismatch between characteristics inherent to the objectives of international criminal trials such as providing accountability and punishment of the accused and delivering justice for victims of mass crimes—the so-called procedural challenges. We also submit that the Court is facing conceptual challenges, related to an apparent misunderstanding of the various concepts at stake: reparations as such and the various modalities and channels of enforcing them. We conclude that although the ICC’s reparation regime may not be the best reparative response to provide justice to victims in conflict situations affected by mass victimization, we suggest that improving the ICC’s approach includes, at a minimum, tackling these challenges.

Since 1945, international criminal justice has been one continuous construction site, an expression of the attitude of international stakeholders and policy-makers that favours temporary solutions to contemporary problems. Even with the creation of the ICC that has not really changed. This chapter will set out a few fundamental and rather radical ideas that aim at initiating a thorough rethinking of the way criminal proceedings at the international level are regulated and run today. It sees itself very much as a call for a principled re-evaluation and for a move away from the attempts of the last two decades of arriving at a genuine amalgam of diverse systems by the method of judicial trial and error. The existing model(s) is/are an exemplary expression of the temporariness of international law, because it/they proceed(s) from a refusal by international law-makers to engage in drafting a permanent model that retains fairness standards while striving for maximum efficiency and that is meant to be applied across the board to any (new) tribunal—an approach that would lead to much greater certainty of law than is currently the case because of an increase in cross-institutional comparability. The chapter contends that while both adversarial and judge-led systems in their own national settings can achieve comparable levels of fairness, they differ in efficiency and that a judge-led model is better suited for the international arena and should be made the foundation for any future permanent procedural framework. However, the temporary nature of the present system which mainly uses adversarial models is based to a large extent on an unprincipled reliance on supposedly ‘ready-made’ and ‘tried and tested’ solutions from as well as the experience of staff employed at previous tribunals. The use of the adversarial model is thus not based on a principled evaluation of its usefulness and effectiveness in the international context but on a default attitude of the lawyers creating and populating international tribunals, and possibly the diplomatic community in the wider sense.

Aquest article tracta el tema del “ne bis in idem” com a garantia processal penal del sistema interamericà de protecció dels drets humans. Tot fent referència als casos portats a la Cort Inteamericana de Drets Humans, s’hi presenten algunes consideracions que s’han tingut en compte a l’hora de flexibilitzar-ne el principi. Aquesta garantia es compara amb el sistema del “double jeopardy” de la common law. Així mateix, es compara també amb altres sistemes de protecció dels drets humans, com l’europeu, el del Tribunal Penal Internacional i el del Pacte de Drets Civils i Polítics de les Nacions Unides. Per concloure, es destaca la importància de l’harmonització de les garanties del procés penal en relació amb la discussió de conflictes jurisdiccionals.
