2. Consultation on the white paper on artificial intelligence : a european approach

SUMMARY From 19 February to 14 June 2020, the European Commission held a Public Consultation on several policy and regulatory proposals that are currently being considered in the area of Artificial Intelligence (AI). This consultation was centered on two main documents presented by the Commission: the White Paper on Artificial Intelligence[1] and the “Report on the safety and liability implications of Artificial Intelligence, the Internet of Things and robotics”[2]. The consultation also included an online survey[3], where the central themes of those two documents were covered in a summarized way. In November 2020, the results of the consultation were presented, as well as the texts accepted for publication[4]. In order to participate in this pre-legislative process, a working group was created within the Faculty of Law and Political Science of the Lusófona University of Porto, which presented a contribution that was accepted and published by the European Commission[5]. The White Paper is centred in one powerful objective which is “to enable a trustworthy and secure development of AI in Europe, in full respect of the values and rights of EU citizens”, and for that presents two central ideas considered essential to attain it that are to create an ecosystem of excellence along the entire value chain and an ecosystem of trust that ensure compliance with EU rules, including rules protecting fundamental rights and consumers’ rights. The text that follows is divided in two main parts: Part I is focused on presenting an overview on the three main topics pointed out at the consultation: Excellence, Trust and Liability; Part II corresponds to text of the contribution submitted in the Public Consultation held by the European Commission. Fraudes na produção científica não são situações raras, mesmo na área da saúde. Entre elas incluem-se alguns tipos de má conduta em autoria, como o plágio e a prática de ghostwriting (escrever um artigo com o nome de outro autor) patrocinada pela indústria farmacêutica. Um outro tipo particularmente nocivo para a ciência é o comércio de trabalhos científicos, que tem crescido na internet e tem sido freqüentemente noticiado na imprensa. OBJETIVOS: Analisar o comércio de trabalhos científicos na internet e o modo como são oferecidos esses serviços. MÉTODOS:Foram selecionadas 18 páginas eletrônicas nacionais que oferecem serviços de elaboração de artigos científicos, monografias, dissertações e teses. Para cada uma foi enviada mensagem solicitando informações sobre a elaboração de uma monografia de conclusão de um curso de especialização fictício. A pesquisa já havia sido realizada, de forma que suas características técnicas, éticas e bibliográficas já eram conhecidas pela autora. RESULTADOS: Dez empresas aceitaram a encomenda e, exceto por uma delas, não se opuseram às condições impostas: pesquisa de campo, aprovação por comitê de ética em pesquisa e utilização das normas de Vancouver. Seis não responderam e duas não aceitaram a encomenda alegando não ter colaboradores disponíveis. CONCLUSÃO: O comércio de trabalhos científicos é uma realidade que pode interferir negativamente na formação ética, científica e profissional de graduandos e pós-graduandos, bem como na produção científica, falseando dados e informações da literatura. Recomenda-se uma nova abordagem principalmente na avaliação de trabalhos de conclusão de cursos e monografias.Frauds in scientific production are not a rare phenomenon, even in the medical field. Among these frauds are some types of authorship misconduct, such as plagiarism and ghostwriting sponsored by pharmaceutical industries. Another type of misconduct, which is particularly detrimental to science, is the ecommerce of scientific works, which has been growing and frequently shown in the press. OBJECTIVE: To analyze the e-commerce of scientific papers and the means by which these services are offered. METHODS: Eighteen Brazilian web sites that offer elaboration of scientific papers were selected. A request for the elaboration of a final essay for a forged post-graduatie course was sent to each of them. The research requested had already been completed, consequently technical, ethical and bibliographical characteristics were already known to the author. RESULTS: Ten enterprises accepted the order and, except for one, they have not objected to the conditions imposed: Field research, approval by an ethics committee on research and use of the Vancouver norms. Six have not replied and two have not accepted the order alleging that they had no co-workers available for the task. CONCLUSIONS: E-commerce of scientific papers is a fact which can negatively interfere in the ethical, scientific and professional development of graduate and post-graduate students, as well as in scientific production by adulterating data and information found in literature. A new approach is recommended, especially when evaluating final essays.

ObjectivesIn this paper we discuss the main ethical challenges related to the conduct of medicine quality surveys and make suggestions on how to address them. MethodMost evidence-based information regarding medicine quality derives from surveys. However, existing research ethical guidelines do not provide specific guidance for medicine quality surveys. Hence, those conducting surveys are often left wondering how to judge what counts as best practice. A list of the main ethical challenges in the design and conduct of surveys is presented. Results and conclusionsIt is vital that the design and conduct of medicine quality surveys uphold moral and ethical obligations and analyse the ethical implications and consequences of such work. These aspects include the impact on the local availability of and access to medicines; the confidentiality and privacy of the surveyors and the surveyed; questions as to whether outlet staff personnel should be told they are part of a survey; the need of ethical and regulatory approvals; and how the findings should be disseminated. Medicine quality surveys should ideally be conducted in partnership with the relevant national Medicine Regulatory Authorities. An international, but contextually sensitive, model of good ethical practice for such surveys is needed. ObjectifsIdentifier et discuter les principaux enjeux ethiques lies a la conduite des surveillances et formuler des suggestions sur la facon de les aborder. MethodeLa plupart des informations fondees sur des preuves en ce qui concerne la qualite des medicaments decoule des enquetes. Cependant, les directives ethiques de recherche existantes ne fournissent pas d'indications precises pour les enquetes sur la qualite de la medecine. Par consequent, ceux menant des enquetes sont souvent laisses a se demander comment juger ce qui compte comme la meilleure pratique. Une liste des principaux defis ethiques dans la conception et la conduite des enquetes est presentee. Resultats et conclusionsIl est essentiel que la conception et la conduite des enquetes sur la qualite de la medecine respectent les obligations morales et ethiques et analysent les implications ethiques et les consequences d'un tel travail. Celles-ci sont: l'impact sur la disponibilite locale et l'acces aux medicaments, la confidentialite et la protection de la vie privee des enqueteurs et des enquetes, des questions quant a savoir si les membres du personnel de sortie doivent etre informes quils font partie d'une enquete, la necessite d'approbations reglementaires et d'ethique et la facon dont les resultats devraient etre diffuses. Les enquetes sur la qualite de la medecine devraient idealement etre menees en partenariat avec les autorites relevantes de reglementation des medicaments nationaux. Un modele international, mais contextuellement sensible, de bonne pratique ethique pour ces enquetes est necessaire. ObjetivosIdentificar y discutir los principales retos eticos relacionados con la realizacion de encuestas y hacer sugerencias sobre la forma de abordarlas. MetodoLa mayor parte de la informacion basada en la evidencia en lo que respecta a la calidad de los medicamentos se obtiene a traves de encuestas. Sin embargo, las guias eticas de investigacion existentes no proveen una guia especifica para las encuestas de calidad de medicamentos. Por lo tanto, aquellos que llevan a cabo las encuestas a menudo no saben como definir lo que se considera como la mejor practica. Aqui se presenta una lista de los principales retos eticos en el diseno y en la realizacion de encuestas. Resultados y conclusionesEs vital que el diseno y el pase de encuestas de calidad de medicamentos apoyen obligaciones eticas y morales, asi como el analisis de las implicaciones y las consecuencias eticas de dicho trabajo. Estas son: el impacto sobre la disponibilidad local de y el acceso a las medicinas; la confidencialidad y la privacidad de los encuestados y encuestadores; preguntas sobre si los trabajadores del punto de entrega deberian ser avisados de que estan formando parte de un estudio; la necesidad de aprobaciones eticas y regulatorias; y como diseminar los hallazgos obtenidos. Las encuestas sobre la calidad de los medicamentos deberian idealmente realizarse junto con las autoridades nacionales relevantes en regulacion de medicamentos. Se requiere un modelo internacional, pero contextualmente sensible, de buenas practicas eticas.

In its typical form, an "anima projection" is a psychic experience in which a heterosexual man is caught up by an intense, almost magical attraction for a woman. What sets these numinous experiences apart from a common "crush" is a pattern of specific phenomenological characteristics. Anima projections are particularly common in late adolescence and early adulthood, when they can cause a deep sense of disorientation. Little education exists for young men on how to deal with these experiences and to actualize the developmental opportunity that underlies them. In this paper, I frame anima projections as an ethical problem and outline a psycho‐ethical "map" that is intended for use by disoriented young men, or by any practitioner who may be tasked with helping them navigate this challenge along the path of individuation. The map considers four solutions to the love problem: the "concretistic‐literal", the "fearful‐avoidant", the "rational‐depressive", and the "transitional‐developmental" solution, and indicates the latter as the one that is conducive to optimal psychic development. Although developed with a focus on young men, the map may apply to other relations based on projection, regardless of age, sex, gender, or sexual orientation. [ABSTRACT FROM AUTHOR]

Often illustrated with the examples of melody, Bergson's key concept of durée is best known for its qualitative, heterogeneous, and thus immeasurable multiplicity. However, the examples he gives in Time and Free Will-such as "the regular oscillations of a pendulum" or "the successive strokes of a distant bell"--suggest rather periodic phenomena that would require another perspective in terms of rhythm. When we "get into a rhythm," we perceive a numerical quality without counting. Rhythm makes glimpse "Otherwise than Measuring". Focusing on the "rhythmic organization of the whole" within duration could reveal the secret of Bergson's enigmatic phrase: "this heterogeneity contains number only potentially." This paper reexamines the theoretical scope of rhythmeasure in two ways. First, it shows how this image médiatrice we forged is going to be renewed by recent studies emphasizing duration-number (Miravete) or multi-time scale theory (Hirai). Second, it explores the ethico-political implications of rhythmeasure. Bergson, in his last book Two Sources of Morality and Religion, multiplies images of "a justice (...) which no longer evokes ideas of relativity and proportion, but, on the contrary, of the incommensurable and the absolute". An oft‐repeated and largely unexamined assumption in Jungian psychoanalysis is the notion of "analyzability", that is, of an individual's ability or present capacity to think symbolically. It is often taught that if someone is unable to think symbolically, a depth analysis is not possible. Such an individual may be more aptly suited for supportive psychotherapy, the argument goes, an experience that may very well lead to the development of the ego's capacity for symbolic thought but is not, in and of itself, a Jungian analysis. While this sort of categorical thinking has, at times, crossed over into ontological claims about individuals and groups, the notion of analyzability encountered in psychoanalytic theory and praxis is often cloaked in facially neutral language. The impact, however, has been anything but neutral in effect. In this paper, I propose a softening of our theoretical edges through a genealogy of the category of analyzability within the broader history of psychoanalysis. Through this excavation, I explore the contingent nature of the category of analyzability, how it has constricted knowledge, perpetuated inequality, and, more broadly, obscured ways of knowing. The Principles of separation of power form the backbone of most democratic nations in the world. This system of governance also incorporates checks and balances. Parliament, Executive, and Judiciary have well-defined powers and functions within the constitutional Framework. The judiciary is vested with the power to check the legitimacy of laws. This power enables the judiciary to review the constitutionality of laws on the touchstone of the constitution. This paper deals with case study of two important cases which includes Common Cause and Government of NCT Delhi. In both the cases court declared the actions of parliament invalid. Parliament passed the amendments to overshadow the ruling of the Supreme Court. Such actions in democracy disturb the governance of the country. Also, such practices in the state are considered unethical. Therefore, this paper highlights such practices in reference to the ethical standard set by the Constitution of India. Artificial Intelligence (AI) is the newest technological hype. Although it involves a great diversity of technologies, the disseminated image of AI has been a generic, super-powerful, extremely negative one, at the edge of dystopian, especially in works of science fiction. Recently, following the launch of ChatGPT, one finds an explosion of journalistic and academic publications, some of which reinforce this public imagination. In academia, AI’s risks remain highlighted and even apocalyptic scenarios related to it are taken into consideration. Ethical concerns, then, take on eminently negative connotations, and the much more realistic possible benefits of AIs are under-focused. We highlight in this paper the importance of going beyond the hype and developing multi/interdisciplinary, delimited, realistic, and thoughtful approaches. Employing the collective intelligence embodied in the interaction between researchers from three fields —Computer Science, Linguistics, and Philosophy— we approach a free machine translation tool: Google Translate. Our goal is to show that well-defined, multidisciplinary, technically supported approaches that do not adhere to sensationalist discourse lead us to more epistemically consistent and more thoughtful critical-normative reflections, which would be crucial for advancing the debate on AI.
