The overall aim of this study was to describe experiences of discrimination due to inaccessibility among people using mobility devices. We conducted a thematic qualitative analysis of 88 complaints about wheeled mobility device use, inaccessibility, and discrimination submitted to the Swedish Equality Ombudsman (DO) during 2015 and 2016. The analysis resulted in three themes: instigating change by invoking laws and regulations and highlighting lack of compliance; demanding to be recognised, understood, and listened to; and struggling for equal access and social participation. Regulations and treaties were invoked as the basis for complaints by people using mobility devices regarding their lack of access to physical environments and impediments to their enjoyment of their full right to participate in and contribute to society. The complaints described feelings of discrimination, the disadvantages and exclusion due to physical inaccessibility, and experiences of being prevented from living one's life as others do. Complaints filed by people using mobility devices showed that they were denied access to a wide range of contexts, including offices, theatres, restaurants, schools, and public transportation, though they desired to live an active and social life outside their homes. Filing a complaint was a way to take action, highlight present inaccessibility, and express a hope for change. Difficulties experienced by people using wheeled mobility devices can reveal knowledge important for revising existing design and renovation standards for housing and public buildings. Documenting facilitators and barriers in different environments is important for giving voice to the needs of wheeled mobility device users and revealing standards that need to be strongly enforced or revised. People using wheeled mobility devices should be supported in finding solutions in inaccessible environments, both to fulfil their wishes and to enable their participation in society. Service animals can play an integral role in the lives and education of students with disabilities. In addition to assisting with physical tasks, service animals can improve confidence, independence and quality of life for students, as well as help them to meet their educational goals. Teachers, coaches and administrators should have the knowledge and skills necessary to support and collaborate with students as they engage with their service animals in and outside of school. The purpose of this article is to educate school personnel about service animals and to help facilitate the successful integration of service animals into schools. Specifically, the article defines service animals and outlines the rights of students with disabilities and their service animals. This column article discusses the state of people with disabilities who work in libraries in conjunction with the Covid pandemic, and the return to working on site. Also discussed is how accessibility changed in libraries because of the pandemic and the shut downs that occurred before vaccination. This article asks administrators to consider several issues including the difference between compliance with the Americans with Disabilities Act and accessibility, compassionate care for library employees and patrons, boundary setting, and embracing change. The authors offer a response to commentaries made on their article about medical aid in dying (MAID) wherein they argue that both bioethical principles and disability rights laws demand that aid-in dying laws be amended to permit others to assist these patients with self administration. They talk about their appreciation for the authors who contribute to the debate, how they provide context for the debate, and the need to revise the self-administration without assistance clauses.

The law library plays a role in the lives of people with disabilities by facilitating their full participation in society. Providing equitable access for persons with disabilities to library facilities and services is required by Section 504 of the Rehabilitation Act of 1973 (Section 504), applicable state and local statutes, and the Americans with Disabilities Act of 1990 (ADA). The ADA was created to eliminate discrimination in many areas, and most libraries are covered by the ADA's Title I (Employment), Title II (Government Programs and Services), and Title III (Public Accommodations). Section 504 is another federal law designed to protect the rights of individuals with disabilities in programs and activities that receive federal financial assistance from the U.S. Department of Education. Recipients of this federal financial assistance include institutions of higher education. This article provides a brief overview of the Americans with Disabilities Act and Section 504 of the Rehabilitation Act of 1973, and why law libraries must comply with these laws to provide equitable access for persons with disabilities. Although the traditional view of access is defined as physical access to the library or the building it resides in, this article asserts that equitable and inclusive access to the law library should be aligned with the expectations of the ADA and Section 504. The purpose of this paper is to discuss the limitations of law interpretations and policy regulations as they pertain to inclusion and exclusion of people with physical disabilities in physical education. We believe interpretation of the law has professional implications that must be addressed. Specifically, the ideal and the reality of the laws as applied to the students with physical disabilities is not the same. We believe we have a duty to include people with physical disabilities in movement activities. To conclude the paper, we, the authors, discuss current research in perspective-taking for pre-service teachers as a solution for including people with physical disabilities in physical education, recreation, and sport. Accessibility to information for disabled human users has increasingly become a legal and ethical concern for public education institutions. The Americans with Disabilities Act guarantees freedom from discrimination for disabled Americans, and recent lawsuits and formal complaints about inaccessible website content have propelled enforcement from an historically reactive stance to one that is proactive. Librarians pride themselves on providing information to all users, and the profession has long understood the need to structure data for other applications. However, many of us fail to use even the simple features built into software packages that can ensure accessible documents and presentations from the point of creation. This failure sets up a paradigm of perpetual effort required to remediate content for accessibility. Mentor relationships are important in developing and supporting professional self-efficacy among psychology trainees. Additionally, the rapid diversification of the United States calls for the preparation of clinical neuropsychology trainees to work within a multicultural context. The present study aimed to assess neuropsychology trainees' perceptions of multicultural climate and supervision and if these perceptions differ based on trainee demographics. We also sought to identify aversive experiences of trainees, program strengths or weaknesses, and how programs support trainees. Participants were 310 neuropsychology trainees (Mean age = 30.27, SD = 5.67) from clinical psychology graduate (n = 136), pre-doctoral internship (n = 38), and post-doctoral (n = 71) programs across the United States and Canada who completed a survey assessing perceptions to multicultural climate and supervision. 64.5% self-identified as women, 60.3% as heterosexual, and 46.1% as non-Hispanic White. 34.5% of trainees reported at least one American Disabilities Act (ADA) recognized disability. Though satisfied with general supervision, trainees reported overall dissatisfaction with multicultural supervision. Satisfaction with multicultural supervision did not differ by demographics. Trainees also reported various aversive experiences with supervisors, clients, and research participants that negatively impacted their training. These experiences were at times due to an aspect of the trainee's multicultural identity, with Black and Hispanic trainees being more likely to report an aversive experience. Trainees reported ways in which they felt unsupported by their programs. Important areas of growth for programs are discussed. Issues raised by neuropsychology trainees overlap to some degree with the experiences of trainees in other fields. Recommendations of approaches that have been successfully adopted in other fields to improve trainee satisfaction are provided. Early identification of needs that go above and beyond clinical training will allow programs to respond promptly, improve trainee satisfaction, and potentially improve the retention of trainees from diverse backgrounds. A policy imperative in light of population aging in the United States is to increase employment among older workers. However, age discrimination, especially in hiring, can impede efforts to encourage older people to work longer. This commentary reviews evidence on age discrimination and laws prohibiting age discrimination, and discusses recent court rulings that affect the strength of these laws. Based on this review, the commentary proposes a number of policy changes to reduce age discrimination in hiring, including: increasing damages under the Age Discrimination in Employment Act (ADEA) to match the larger damages that some states allow; amending the ADEA to clarify that claims based on statistical differences in the effects of employer policies ("disparate impact claims") are allowed for hiring discrimination, and that the standard for establishing discrimination is not that age was the determining factor in creating the disparity (the "but for" age criterion), rather that it was simply a contributing factor; amending the ADEA to allow intersectional claims regarding age and other group membership – especially regarding discrimination against older women; extending affirmative action for federal contractors to older workers; and considering strengthening the Americans with Disabilities Act (ADA). An increasing number of individuals are requesting disability accommodations on high-stakes licensing examinations, and neuropsychological evaluation reports are a frequent component of disability documentation. This study reviewed 103 requests for accommodations based on a learning disability (LD), submitted to the National Board of Osteopathic Medical Examiners between 2013 and 2016 for accommodation on the licensure exams for osteopathic physicians. Depending on criteria employed, anywhere from 84 to 97% of applicants failed to meet recognized criteria for a LD diagnosis, with the vast majority demonstrating academic functioning that was average or better relative to most other individuals in the general population. Thus, although given a disability diagnosis, the majority lacked evidence of substantial impairment that would require accommodations under the Americans with Disabilities Act. Additionally, no significant differences were found between the academic achievement or fluency scores of those requesting 50% as compared to 100% extra time. Finally, many evaluators employed grade-based assessment measures to demonstrate academic impairment, even when candidates' functioning using age-based comparisons was unimpaired. This paper reports the results of the examination of the homepages of Illinois public library websites for language, design, layout, and efficacy based on the recommendations of the Americans with Disabilities Act, Section 508 and the Web Content Accessibility Guidelines developed by the World Wide Web Consortium. The homepage of each public library website in Illinois was analyzed using the AInspector Sidebar online tool which inspected webpage landmarks, headings, content, images and links to determine which elements passed, violated or issued a warning or required a manual check to meet specific recommendations. A discussion of these results includes consideration of American Library Association website design standards as well as the standards of the Illinois Public Library Association. Since the library website provides virtual access to information, government forms, employment applications and resources for assistance, it is vital to consider the needs of those with disabilities when designing library websites. Without kidney transplant, treatment for end-stage renal disease is considered lifelong. Non-emergency medical transportation through Medicaid and the complementary paratransit services under the Americans with Disabilities Act 1990, were identified as the two major sources of transportation services for end-stage renal disease patients. The purpose of the study was to explore barriers to transportation experienced by dialysis patients using transportation services for in-center dialysis and transplant related medical appointments. The study used a non-experimental quantitative research design to explore the barriers and used web-based survey to collect the data. The link to the web-based survey was disseminated on National Kidney Foundation's Facebook and online forum and the survey collected 231 responses. The results of the study indicated prevalence of barriers to transportation for patients with end-stage renal disease. The barriers pose a risk for shortening or missing dialysis appointments affecting dialysis patient's health, leading to an increase in hospitalization and mortality rates. The findings of the study provided foundations for interventions and policy implications to diminish barriers to transportation for patients with end-stage renal disease. Future studies may address barriers to transportation based on end-stage disease patients' physical limitations and at different geographic settings. [ABSTRACT FROM AUTHOR]

The Americans with Disabilities Act (1990) mandates the inclusion of individuals with disabilities to a broad range of facilities and public buildings. One overlooked area is access to conferences. Conferences are held in a range of buildings, including purpose-built venues, hotels, and stadia. Often, the focus is on access for people with mobility limitations, but access for people with other disabilities, such as vision or hearing loss, or mental ill-health, can be overlooked. This is a significant oversight since around 19% of the population experience a disability (Brault, 2012): it makes sound business sense, as well as a sense of social justice, to ensure more people can access conferences. This article uses a literature review methodology to highlight key considerations to make conferences more accessible to a broad range of people with disabilities. A theoretical framework of Universal Design is proposed to support the ideas. A holistic approach is taken to inclusion, including online booking, transport, and parking, since, without these being accessible, the event becomes inaccessible. Other aspects considered include registration, seating, restrooms, catering, and communication aids. While the percentage of the population with disabilities is growing, little research has been reported to date on documenting disability accommodations at meetings and events. By using a combined analysis, consisting of text mining and document analysis, this study analyzes industry magazine articles published from 1991 to 2020 that address disability accommodations and ADA (Americans with Disabilities Act) requirements. Findings provide key concepts, relevant topics regarding ADA compliance, the evolution of content over time, and ADA-related practices and implications for planners. This study also discusses the legislation and guidelines applicable to both physical and digital accessibility. The findings will be of interest to venue managers and meeting planners, as well as event organizers. An adapted grading system for students with disabilities in general physical education allows utilization of existing assessment tools such as rubrics and checklists and provides methods of individualization and modification based on the student's needs. Adapted grading methods include weighting components of class grades and unit assessments, calculating a level of difficulty score, and establishing supplementary grades including a level of attainment and level of independence grade. All methods discussed provide the general and/or adapted physical educator with strategies for generating valid numerical grades for their students with disabilities. Since the implementation of the Americans with Disabilities Act (ADA), efforts have been made to increase access to public services, businesses, education, and public spaces for all members of the community. However, digital accessibility to information online is regularly an afterthought or applied retroactively, rather than a standard consideration integrated into the creation, instruction, and dissemination of information resources. Libraries can serve as advocates for increasing digital accessibility to information resources. This column will investigate what technologies are currently being utilized for digital accessibility, discuss concerns related to digital accessibility, and consider methods for libraries to become more involved with supporting and integrating digital accessibility into online library services. Per the 2019 NASIG Core Competencies for electronic resources librarians (ERL), ERLs "work with concepts and methods that are very much in flux ... [they are] knowledgeable about the legal framework within which libraries and information agencies operate... [including] laws relating to... equal rights (e.g., the Americans with Disabilities Act)". However, the Core Competencies do not define the level to which an ERL is responsible for determining the accessibility of an electronic resource. This article aims to create a better understanding of the steps an ERL can take to develop an accessibility statement pertaining to procuring accessible content. This article synthesizes key laws and policies that ERLs should be aware of in order to draft an accessibility procurement statement for their institution. On the 29th anniversary of the Americans with Disabilities Act, the author takes stock on what the Act has accomplished thus far and what still needs attention, as he reflects on Andrew I. Batavia's (Drew) discovered memoirs and his life mission as a disability activist. Drew was a person with a spinal cord injury who wrote regulations for the Act. Aim: Increasing usage of cultural arts venues by children with special needs has created a need to optimize participation planning. A team of three occupational therapy graduate students and one faculty researcher was invited to provide a local children's theater staff with training for supporting children with special needs. The team aimed to determine how their collaboration with the theater could contribute to understandings of best practices in community participation planning.Method: The team participated in theater events, conducted a facility assessment, interviewed staff members with varying role responsibilities, and surveyed staff before and after conducting a participation-planning workshop.Results: The collaborative approach to participation planning utilized strategies that provided practical applications for theater staff, including planning for sensory processing and regulation challenges, and providing staff with behavior management and communication tips for interacting with children.Conclusion: Through training, staff participation planning evolved from reacting to present-day problems to proactively planning for future initiatives. Staff expressed desires to have some of their own members become in-house experts for participation planning, allowing others to pursue the theater's mission: providing live children's theater performances and programs. Drawing upon sources in neuroethics, civil rights, and disability rights law, we argue for the reintegration of people with severe brain injury back into the nexus of their families and communities consistent with the Americans with Disabilities Act (ADA) and the UN Convention on the Rights of Persons with Disabilities, both of which call for the maximal integration of people with disability into society. To this end, we offer a rights-based argument to address the care of people with severe brain injury. Instead of viewing the provision of rehabilitation as a reimbursement issue, which it surely is, we argue that it can be productively understood as a question of civil rights for a population generally segregated from the medical mainstream and from society itself. Their segregation in the chronic care sector constitutes disrespect for persons, made all the more consequential because recent advances in brain injury rehabilitation make reintegration into civil society an aspirational, if not achievable goal. Research points to significant numbers of students on college campuses experiencing mental health distress and an ever increasing number of college students who are choosing to make an off-campus educational experience a part of their college careers. When we consider both of these trends together, it is quite apparent that a significant number of students with mental health concerns will spend periods of time studying away from campus, with converging concerns among college mental health and study away professionals about how to best support these students. This article seeks to outline both challenges and opportunities inherent in the collaboration between campus professionals in supporting students with mental health issues before and during their study away experiences. The Americans with Disabilities Act celebrated its twenty-fifth anniversary in 2015. Enacted by Congress and signed into law by President George H.W. Bush, the ADA was designed to ensure that people with disabilities are given “independence, freedom of choice, control of their lives, the opportunity to blend fully and equally into the rich mosaic of the American mainstream.” The ADA defines the kinds of public and private spaces that must provide access and accommodations to the disabled. Missing from that list, because of the ADA's timing, is the Internet, effectively shutting the disabled out of the rich marketplace of ideas online. This article examines both the case law surrounding this omission and delays by the executive and legislative branches in extending the ADA to the Internet. Disruptive students potentially pose significant problems for campus administrators as they strive to maintain a safe campus environment conducive to learning while not violating the legal rights of the students. Maintaining a safe campus is important because increasing numbers of students with mental and cognitive disorders are enrolling in college and university classes. This article examines selected court cases involving disruptive students who alleged violations of their First Amendment right of free speech, due process rights under the Fourteenth Amendment, and violations of the rights afforded them under the Americans with Disabilities Act and the Rehabilitation Act. This paper interrogates the language of the legal precedents of the Americans with Disabilities Act (ADA) and their function, including the 1891 Immigration Law and the series of ‘ugly laws’ that spanned from the late nineteenth century until the early twentieth century. Legislative language is used to construct and deploy static definitions of normalcy and disability, relying on ‘objective’ evidence couched in medical and scientific discourse. The purpose of this paper is to uncover the legislative precedents of the Americans with Disabilities Act Amendments Act (ADAAA) that were motivated by the eugenicist imperative to strengthen the image of a productive and robust nation. I begin by outlining eugenicist logic and demonstrate how it functions within a semiotic system. Then, I will introduce the process by which eugenicist logic works within legal semiotics. Lastly, I will provide three examples of how this process functions in the legislative language and implementation of the 1891 Immigration Act, the ‘ugly laws’ and the ADAAA. Ultimately, I will demonstrate how all three provide evidence of a pattern of semiotic systems that pathologize human difference and manages these differences so as to segregate and disenfranchise in the name of nationalism. Providing therapy to deaf clients raises important ethical considerations for psychologists related to competence; multiple relationships and boundary issues; confidentiality; assessment, diagnosis, and evaluation; and communication and using interpreters. In evaluating and addressing these, psychologists must consider the American Psychological Association’s Ethics Code and other relevant issues (e.g., Americans with Disabilities Act) necessary to provide ethical treatment. The current article provides background, ethical considerations, principles and standards relevant to the treatment of deaf clients, and recommendations to support psychologists, training programs, and the field. Purpose: The slopes of fixed-route bus ramps deployed for wheeled mobility device (WhMD) users during boarding and alighting were assessed. Measured slopes were compared to the proposed Americans with Disabilities Act (ADA) maximum allowable ramp slope.Methods: A ramp-embedded inclinometer measured ramp slope during WhMD user boarding and alighting on a fixed-route transit bus. The extent of bus kneeling was determined for each ramp deployment. In-vehicle video surveillance cameras captured ramp deployment level (street versus sidewalk) and WhMD type.Results: Ramp slopes ranged from −4° to 15.5° with means of 4.3° during boarding (n = 406) and 4.2° during alighting (n = 405). Ramp slope was significantly greater when deployed to street level. During boarding, the proposed ADA maximum allowable ramp slope (9.5°) was exceeded in 66.7% of instances when the ramp was deployed to street level, and in 1.9% of instances when the ramp was deployed to sidewalk level. During alighting, the proposed ADA maximum allowable slope was exceeded in 56.8% of instances when the ramp was deployed to street level and in 1.4% of instances when the ramp was deployed to sidewalk level.Conclusions: Deployment level, built environment and extent of bus kneeling can affect slope of ramps ascended/descended by WhMD users when accessing transit buses.Implications for RehabilitationSince public transportation services are critical for integration of wheeled mobility device (WhMD) users into the community and society, it is important that they, as well as their therapists, are aware of conditions that may be encountered when accessing transit buses.Knowledge of real world ramp slope conditions that may be encountered when accessing transit buses will allow therapists to better access capabilities of WhMD users in a controlled clinical setting.Real world ramp slope conditions can be recreated in a clinical setting to allow WhMD users to develop and practice necessary skills to safely navigate this environment.Knowing that extent of bus kneeling and ramp deployment level can influence ramp slope, therapists can educate WhMD users to request bus operators further kneel the bus floor and/or redeploy the ramp to a sidewalk level when appropriate, so that the least practicable slope will be presented for ingress/egress. Higher education institutions are often well prepared in terms of accommodation policies and practices for disabled students. Ironically, campuses are often not prepared once disabled academics return as faculty. Most are particularly unfamiliar with the unique access needs of deaf or hard of hearing academics. This can result in career hindrances to employment and tenure, as well as potential losses to campuses in terms of diversity. Background and substantiation on this access issue is provided along with recommendations for policy-making and practices for campuses that are geared to ensuring career success for deaf and hard of hearing faculty. The increased development and use of electronic and information technology in higher education raises questions about accessibility for individuals with disabilities. In academic libraries, providing accessible electronic information resources ensures equal access and opportunity to information. This article provides a contextual understanding of accessibility in higher education as well as strategies for evaluating, negotiating, and procuring accessible electronic resources licensed through third party vendors. Developmental disabilities in children can be challenging to the family who desires a spiritual home for their family. Parents may hesitate to bring a special needs child to a church service, uncertain of the outcome. While public schools have amazing support for the differently abled, the Church very rarely has assistance in place for the families of handicapped individuals, let alone theology for the parents of mentally disabled children. This paper will examine possible ways for a local church leader or volunteer to educate children with mental disabilities, drawing on a variety of texts for support. With the increasing size and complexity of modern buildings, 3D indoor routing is receiving more attention nowadays. Different elements such as route finding, indoor modelling, and route visualisation need to work together to achieve this goal. For this purpose, we propose a framework that makes use of existing data sources and tools that can minimise the time and effort needed for potential 3D indoor routing applications. Our 3D indoor and building models are generated from CAD files and building footprints using CityEngine and its built-in procedural modelling approach. An Americans with Disabilities Act (ADA) compatible 3D network is created by combining 3D floor lines and transitions such as staircases and elevators. The resulting routes as well as the indoor and façade models are then visualised through a 3D WebScene generated by CityEngine. Academics and policy-makers focused on protecting older inmates (ages 50 and above) in US prisons from medical neglect, psychological problems, victimization by younger inmates, and functional decline as a result of excessive environmental strain have long advocated for their placement in age-segregated units and facilities. In response, proponents of age-integrated units and facilities have argued that age-segregation violates the integration mandate of the Americans with Disabilities Act (ADA) of 1990 because older inmates in age-segregation are not provided equal access to facilities and programs. This paper examines the age-segregation debate through an analysis of the social science and legal literature to include court cases, the ADA, the ADA Amendment Act of 2008, and the related 2010 federal regulations. Exceptions to the ADA's integration mandate are assessed for their ability to provide legal support for the practice of age-segregation. This paper concludes with recommendations for creating and maintaining fully and partially age-segregated units or facilities that would operate in compliance with the 2010 federal regulations while efficiently and effectively meeting older inmates' unique needs. The license negotiated at the beginning of the electronic resources lifecycle impacts access to the resource throughout the life of the contract. To simplify the negotiating process, the Texas A&M University (TAMU) Libraries developed a licensing checklist. In order to make completed licenses accessible to all library personnel, the TAMU Libraries use the electronic resources management system Centralized Online Resources and Licensing (CORAL) to store license documents and terms. This presentation reviewed the TAMU Libraries’ licensing process, the creation and evolution of the licensing checklist, and the suitability of CORAL to share license details. Students with disabilities are a growing population in higher education (National Center for Education Statistics, 2009). Providing accommodations for students with disabilities can raise ethical and social justice questions and pose challenges for social work faculty, administrators, and field instructors. Social work educators must balance the legal mandates for nondiscrimination and reasonable accommodation against ethical obligations around protection of clients and preparation for practice.
