?Diversity? has become a fashionable and plastic buzzword over the past thirty years. With the recent U.S. Supreme Court cases concerning affirmative action at the University of Michigan, the concept of diversity has received even greater public scrutiny. The existing scholarly literature that examines discourses about diversity usually relies on macro-level, legal, or text analyses, overlooking people?s interpretations of diversity in their everyday practices. The proposed paper helps to fill in this gap. It draws on over a year of ethnographic evidence about how interests groups involved in the lawsuits against UM?including university administrators, pro- and anti-affirmative action activists, legal professionals, and political leaders?politically and legally mobilized around the lawsuits and then responded to the Court?s decisions. The paper builds on cultural analyses of the law and collective action by examining how various interest groups negotiate different socio-legal paradoxes around diversity. Preliminary findings show how nearly every group is in favor of ?diversity,? but they all confront challenges when defining this concept and putting it into practice. For example, outsider activists?both in favor of and opposed to affirmative action?talk about diversity by simultaneously endorsing it and questioning its relevance, meaning, or existence. The proposed paper concludes with a discussion of how ideas related to law acquire constituencies, constitute the categories through which people construct the world, and ultimately shape their efforts to address different social problems. Background: This research outlines important factors in the development of a for-credit internship program by providing a historical context of internship work dating back to the original case of Walling v. Portland Terminal (1947), which outlined acceptable non-paid work of trainees, to more current applications of these labor laws in Wang v. Hearst (2016) and Glatt v. Foxlight Pictures (2016) then connects those legal precedents with current research in best practices. Purpose: The purpose of this research was to examine legal implications on for-credit internship programs and create recommendations based on United States law. Methodology/Approach: This work uses peer-reviewed research to support recommendation in internship development, implementation, and evaluation. Findings/Conclusions: Recommendations for programmatic implementation are made to avoid potential litigation against higher education institutions, faculty, staff, students, and internship placement organizations. Implications: These legal cases inform higher education and considerations in change to organizational policies and practices as it relates to fair labor, program development, and oversight of experiential education. Abstract

Litigation, for a variety of reasons, has proven to be an imperfect platform to resolve conflicts arising on university campuses. Aside from the anxiety, wasted cost, and time associated with litigation, both students and university administrators run the risk of damaged relationships and very embarrassing publicity when they resort to litigating their conflicts. Litigation by its nature is adversarial and results in win/lose outcomes. Given these realities, universities have turned to mediation as an alternative conflict resolution tool: a tool which affords both parties the ability to resolve their conflict in an environment where confidentiality may be preserved and relationships salvaged. Mediation affords disputants the opportunity to voluntarily formulate win/win outcomes addressing their respective needs. However, mediation is not suited for all disputes arising on campus. For instance, in cases involving criminal assault, searching for a mutual agreement between the victim and the perpetrator is not feasible. Similarly, where a university expels a student for cheating or plagiarism, the university may have an institutional interest in proceeding to court so that it may vindicate its position and establish precedent for future disputes.
